Feed-in tariffs (“FITs”), common in Europe and other parts of the world, thus have come to be seen by many policymakers as a binary alternative -- to promote renewable energy, they assume they must choose either RPSs or FITs, not both. This article challenges that presumption. It outlines how RPSs and FITs can be used in tandem, laying out the ways using these policy tools together may be synergistic. RPSs and FITs have different strengths. RPSs offer greater policy clarity, whereas there is some evidence that FITs are more effective and efficient. RPSs and FITs also target different segments of industry: RPSs utilities, FITs energy producers. Thus, using RPSs and FITs together may produce a number of benefits: (1) a stronger signal of governmental support for renewable energy, (2) a broader scope of applicability, (3) greater policy clarity, (4) better policy planning, (5) greater effectiveness, (6) simpler compliance, and, potentially, (7) lower implementation costs.

Book excerpt: A federalist form of government is used in several important nations, including the United States, Germany, India, Australia, Brazil, Canada, Malaysia, and Switzerland. A federalist form of government divides political sovereignty between a central federal authority and constituent states or provinces. To implement new government policy regulating private power, the challenging transcendent issues are legal and regulatory, rather than technical. Certain measures in various industrialized countries, when implemented at the state rather than federal level, must be designed and implemented carefully to achieve a legal, regulatory fit in a federalist system of government. For purposes of comparison, this article considers the recent initiatives in many of these countries to alter the energy infrastructure from fossil-fuel to renewable energy options. While not all federalist systems in the world are the same, the United States offers a rubric for analysis. With close examination of policies attempted to be implemented by states in the United States, this article examines legal issues arising in implementing policies in a federalist system. Many things can go wrong or right, with more regulatory issues than first apparent.

Book excerpt: Renewable energy sources (RES) capacity has grown globally at a rapid rate benefiting from multiple support schemes such as renewable portfolio standards (RPS), feed-in-tariffs (FIT), and market premia (MP). While research concentrated on comparing the effectiveness of these policy instruments in driving RES investment, the focus is increasingly shifting towards assessments of the structural impact of these schemes on electricity markets. RES support schemes are continuously being assessed on how they help achieve the three main objectives of electricity policy, i.e., the affordability, reliability, and sustainability of electricity supply. In this work, we quantitatively compare RPS, FIT and MP schemes in these three dimensions by assessing their future impact on electricity prices, on generation portfolios and security of supply as well as on carbon emissions. We simulate the impact of all three support schemes using a long-term capacity expansion model with an hourly granularity for a time horizon of 60 years. We find that all support schemes increase RES penetration and thereby help reduce CO2 emissions. However, MP and FIT schemes can achieve these effects at lower cost, while RPS schemes deliver more robust results. Our findings provide insights to regulators, utilities and investors on the consequences of current regulation and possible alternatives.
