Elle entraîne la compétence administrative et déclenche l'application d'un régime juridique exorbitant du droit privé. Si cette conception, forgée entre la toute fin du XIXe et la première moitié du XXe siècle, est encore celle à laquelle on se réfère volontiers aujourd'hui, c'est davantage pour ses vertus pédagogiques que pour sa force probante. En effet, le contrat administratif a connu, au fil des années, une double évolution qui a conduit à une modification progressive de ses contours et à une transformation profonde de son régime juridique. Sur le plan de la compétence juridictionnelle, il ne fait plus aucun doute que le contrat administratif est davantage une catégorie juridique construite par le juge qu'une notion ayant sa nature propre. Cette impression se confirme largement au regard de la tendance jurisprudentielle qui est, depuis quelques années, à la privatisation du contentieux des contrats administratifs. Sur le plan du droit applicable, tandis que l'originalité du régime juridique du contrat administratif ne cesse de décliner sous l'effet d'un double phénomène de privatisation du droit des contrats administratifs et d'"administrativisation" du droit commun des obligations, son degré de spécialisation ne cesse d'augmenter à tel point que l'on accorde désormais la plus grande importance à la "catégorisation" des contrats administratifs et aux règles spéciales qui les régissent.

Jusqu'à présent centrée sur la fin du contrat et ses conséquences, la doctrine publiciste n'a pas envisagé la période postérieure au contrat. C'est à cette lacune que se propose de répondre l'étude de l'après contrat. L'après-contrat est ainsi la période de temps qui succède au contrat, au cours de laquelle les parties continuent d'entretenir des relations contractuelles. Au travers de ces relations, c'est l'influence du contrat qui se poursuit en dépit de sa disparition. Les effets qui se maintiennent après le contrat, et donc l'influence qui se poursuit, dépendent à la fois du type de contrat (marché, concession, occupation domaniale...) et de la cause de sa fin (normale, anticipée pour motif d'intérêt général, pour faute, caducité, force majeure...). Néanmoins, les effets peuvent se classer dans deux catégories selon qu'ils sont relatifs à l'objet du contrat ou à ses moyens d'exécution. Les effets disparaissent progressivement, c'est la réalisation de l'après-contrat. En se réalisant l'après-contrat remplit une fonction principale de clôture de la relation contractuelle existante. Une seconde fonction, moins développée en raison des exigences procédurales qui pèsent sur les contrats administratifs, est d'organiser l'avenir de l'activité réalisée par le contrat. En vertu de la continuité du service public, l'avenir est davantage celle de l'activité que de la relation contractuelle existante. Période de temps limitée, la réalisation de l'après-contrat signifie le retour à la liberté des parties.
