Available in PDF, EPUB and Kindle. Book excerpt: This book critically engages with a series of provocative questions that ask: Why are contemporary societies so dependent on constructive and destructive effects of individualization? Is this phenomenon only related to the ‘second’ or ‘late’ modernity? Can the concept of individualization be productively used for developing a sociological diagnosis of our time? The innovative answers suggested in this book are focused on two types of challenges accompanying the rise of individualization. First, that it is caused by controversial changes in social structures and action patterns. Second, that the effects of individualization question varieties of the common good. Both challenges have a long history but reached critical intensity in advanced contemporary societies in the context of current globalization.

Book excerpt: Employing her original concept of the ontopoiesis of life, the author uncovers the intrinsic law of the primogenital logos - that which operates in the working of the indivisible dyad of impetus and equipoise. This is the crucial, intrinsically motivated device of logoic constructivism. This key instrument is engaged - is at play - at every stage of the advance of life. In a feat unprecedented in the history of western philosophy, the emergence and unfolding of the entire orbit of the human universe is shown to bear out this insight. Furthermore, the intrinsic rhythms of impetus and equipoise are taken as a guide in uncovering the workings of the logos all at once, in contrast to the piecemeal exposition of a single line of argument. In a schema covering the entire career of beingness-in-becoming between the infinities of origin and destiny, an historically unprecedented harmonizing all sectors of rationality is accomplished in a span of reflection comparable to Spinoza's Ethics. The work draws on interdisciplinary investigations in both science and the arts. All of the history of Occidental philosophy finds summary in it, even as feelers, guidelines, leitmotifs are thrown out for its future development. A landmark of Occidental philosophy at the turn of the millennium.

Available in PDF, EPUB and Kindle. Book excerpt: The Sentencing Council of England and Wales has as its core aim to promote consistency in sentencing, with a developed system of appellate guidance at sentencing in addition to a narrative guidelines system which is now two decades old. As such, there is much to analyse and many lessons to be learned - for England and Wales and other jurisdictions. Consistency in sentencing is widely regarded to be an essential component of a fair sentencing system; but what does consistency mean exactly? In Achieving Consistency in Sentencing , the author maintains that consistency incorporates both substantive and procedural elements, focussing upon the proper application of principle. The notion of comparing 'like' cases is rejected as simplistic, impractical, and unprincipled. Lyndon Harris argues that a more principled approach reconciles the tension between consistency and individualised justice which has been suggested to exist. The author uses clear empirical evidence of inconsistency in sentencing to emphasize the crucial need for discretion during the sentencing exercise which, he argues, should be structured in a way that encourages sentences to be imposed in accordance with the principles underpinning the scheme while maintaining the ability to individualise sentences. Using England and Wales as a case study, this work analyses various methods of structuring discretion. The latter part of the book examines the interplay between the primary givers of guidance: Parliament, the Court of Appeal (Criminal Division), and the Sentencing Council and draws conclusions (good and bad) as to ways in which consistency can be achieved. Lyndon Harris identifies lessons to be learned while pointing out the strengths and deficiencies in the various devices used to guide sentencing judges when they are required to exercise their discretion. The book draws attention to the need for greater flexibility and structure while emphasising the work that needs to be done to address racial and gender inconsistencies in sentencing. Thus, while providing a theoretically sound critique of the concept, this monograph is of direct practical relevance to those studying or practising in sentencing systems worldwide.

Book excerpt: "Can there be a more flagrant challenge to the recent - and classic - relativisms, scepticisms and 'deconstructivisms' toward reason, rationality, logos than the Vision of the Manifestation of Life?" As Tymieniecka writes in the introduction to this second book on the constructive appreciation of reason (first book: Analecta Husserliana, Vol. XXXIX), the works of the logos manifest themselves indubitably in the edifice of life. Among perspectives in the compass of reason of this collection: individualisation of life, human existence, reason and doxa (studies by Tymieniecka, Kelkel, Schrag, Buscaroli, Kelly, Laycock, and others) the emphasis falls upon 'inner rationalities' of the spirit, creativity, culture (Bosio, D'Ippolito, Delle Site, Barral, Wittkowski, Regina, Haney, Ales Bello, Sivak, Elosequi), culminating in the issues of historiography and history by Mario Sancipriano, to whom the book is dedicated. This collection stems from the work of The World Phenomenology Institute, mainly its two congresses held in Dubrovnik, Yugoslavia, and Verona, Italy.
