Available in PDF, EPUB and Kindle. Book excerpt: The 13th edition, while retaining materials that have stood the test of time, represents a major overhaul of the text, with significant changes to every chapter. The changes are meant not only to update the text but to give the entire book a fresh, new feel. It is designed to give students a strong sense both that much of the law of evidence reflects enduring principles and that it continues to respond to contemporary situations and problems. This edition retains what has made this book so distinctive for decades, classic problems and materials, some of them from non-legal sources. Teachers who have used prior editions will still find here their favorites. But this edition replaces many old materials that have a tired feel with new ones from the last few years. The new edition adds three important new Supreme Court cases, one on the right to confrontation and two on impeachment of jury verdicts, and numerous significant and interesting cases from state courts and lower federal courts. The authors have continued the practice of choosing cases and other materials on the basis of teachability, and the additions promise to be fun to teach. At the same time, the authors have tightened up on the entire text, so that this edition is significantly shorter than the last one.

Book excerpt: To access the 2016-17 Supplement to this book, click here. This casebook provides a comprehensive, problem-based approach to studying the rules of evidence. Organized around the federal rules, this casebook provides coverage of every single rule; yet, through careful case choice and editing, Professor Nicolas has produced a book that can easily be taught from cover-to-cover in as few as three semester hours. Key features of the casebook include approximately 115 in-depth problems that are designed to teach all the nuances of the rules, as well as coverage of selected state rules of evidence that differ significantly from the federal rules designed to facilitate class discussion about the policies underlying the rules of evidence. In addition, the casebook contains an enriched section on scientific evidence, in-depth coverage of the rules to electronic evidence, and a chapter on appellate review of evidentiary rulings. The revised third edition of the casebook builds on the strengths of previous editions while at the same time updating it to reflect recent developments. The text has been revised to reflect the language of the Restyled Federal Rules of Evidence as well as all substantive amendments through December 2013. The revised third edition contains edited versions of the Supreme Court's most recent Confrontation Clause decisions, including Melendez-Diaz v. Massachusetts, Michigan v. Bryant, Bullcoming v. New Mexico, and Williams v. Illinois. The revised third edition also includes recent decisions applying the rules of evidence to electronic evidence, including cases involving information found on social networking websites. In addition, it contains expanded coverage of state rules of evidence that differ significantly from the federal rules. Finally, in an effort to keep the book manageable in length, Professor Nicolas has--as a general rule--tried to remove a page of material for every new page added. An annual supplement is produced each year that includes the latest developments in evidence law so as to keep the textbook up-to-date between editions. A separate statutory supplement includes the federal rules of evidence and selected legislative history. In addition, the Teacher's Manual includes detailed answers to all of the problems contained in the casebook.

The emphasis is decidedly on primary materials: well-edited principal cases, followed by notes that inform the student on important details and developments. Each chapter covers an article of the Federal Rules of Evidence. Within the chapters and sections, the materials generally follow the sequence of the Rules. The 8th edition covers all important recent developments, including federal and state court decisions interpreting the Rules, the Supreme Court's decision in Peña-Rodriguez v. Colorado (2017), and recent state developments concerning prior offenses in sex crime cases.

This is the Fifth Edition of the textbook that pioneered the teaching of Evidence using problems rather than appellate opinions. The text explores the Rules of Evidence and their rationales in a straightforward fashion without hiding the ball or ignoring complexities. Problems that clarify the Rules appear throughout the chapters; larger problem sets that explore the Rules in detail are found at the ends of chapters. The updated edition discusses important recent cases and introduces social science findings and recent developments in science and technology that bear on the design and operation of the Rules of Evidence, and on their rationale.

Evidence Under the Rules: Text, Cases, and Problems is one of the?most widely adopted Evidence casebooks ever published. Structured around the Federal Rules of Evidence, the book contains carefully edited cases and secondary materials, as well as numerous problems that allow students to apply new concepts during classroom exercises or on their own. Text boxes provide interesting background on select cases and additional perspectives on key issues. New to the 10th Edition: Additional problems are provided, and often these are combined into the Notes following cases and other materials. These problems generate good classroom discussion, without displacing conversations about the cases and the principles under consideration. The book is also redesigned, with more colors on the page, and other design features that provide clues to the content of the textual material. The Note material, found after cases and textual accounts, includes organizational headings that act as signposts calling the attention of students to the key issues. The book retains the old favorites, like Boys on the Bridge (Problem 2-C), A Papier Mache Man (Problem 3-I), and “If You Want to Stay Healthy (Problem 4_Q). New end-of-chapter quizzes are included to help in the review of the materials. A thoroughly updated and expanded Index. Benefits for instructors and students: Introductory text that provides a foundation for understanding the cases and materials that follow. Numerous problems that treat cutting-edge issues, allowing students to apply important concepts to contemporary evidentiary problems. A Teacher’s Manual that provides suggestions by the authors for discussing the Notes and cases. “Comment/Perspective” text boxes that provide broader perspectives to aid in understanding doctrine. Sidebars that contain photographs and text relating to important cases, offering background on how the evidence issue arose.

Book excerpt: Buy a new version of this Connected Casebook and receive access to the online e-book, practice questions from your favorite study aids, and an outline tool on CasebookConnect, the all in one learning solution for law school students. CasebookConnect offers you what you need most to be successful in your law school classes - portability, meaningful feedback, and greater efficiency. Evidence: Cases, Commentary, and Problems offers comprehensive coverage of the topics and concepts central to evidence law, while remaining concise enough to cover in a four-unit course. Organized around the Federal Rules of Evidence, with carefully edited cases, thought-provoking problems, and a wide variety of secondary material, this casebook gives students a solid foundation in the principles and debates surrounding evidence law without the confusion of more encyclopedic approaches. Features of Evidence: Cases, Commentary, and Problems: Comprehensive coverage of all subjects traditionally covered in evidence courses, as well as areas of emerging debate. Well-selected, tightly edited cases illustrate the central concepts and controversies of the law rather than attempting encyclopedic coverage. Carefully selected problems--some hypothetical and some based on actual cases--allow students to test their understanding of particularly confusing rules. Compelling excerpts from treatises and law review articles; portions of the legislative history of the Rules, particularly the Advisory Committee Notes; and congressional reports and floor debates augment the cases. Thoughtful organization of the material is based on the Federal Rules of Evidence and leverages the Rules as a teaching tool. Chapter 1 provides the background knowledge assumed in most discussions of evidence law, including judicial opinions, the Federal Rules of Evidence, and the Legislative History of the Rules. Thoroughly updated, the revised Fourth Edition presents: New material reflecting developments in confrontation clause jurisprudence, especially as relates to Melendez-Diaz v. Massachusetts and Michigan v. Bryant. New material on privilege and physical evidence. Numerous new cases added, with older ones moved to the website. Revised material to reflect technical and jurisprudential developments in the field of scientific proof.
