Con la presente Guida Operativa si cerca di individuare il limite tra potere di controllo ed esigenze di tutela della privacy, in una realtà che ha continuato a presentare una casistica sempre nuova, operando nei fatti un costante superamento dell’originale impianto previsto dal legislatore nel 1970. Con la riforma del Job Act si è intervenuti sull’art. 4 dello Statuto operando una revisione della disciplina dei controlli a distanza sugli impianti e sugli strumenti di lavoro, tenendo conto dell'evoluzione tecnologica e contemperando le esigenze produttive ed organizzative dell'impresa con la tutela della dignità e della riservatezza del lavoratore. La Guida si presenta in 4 parti: i controlli tecnologici cioè quelli esercitati attraverso gli strumenti tecnologici che il datore fornisce al lavoratore; I controlli tradizionali esercitati dall’uomo cioè la tutela della riservatezza e i controlli sanitari; gli adempimenti obbligatori e le procedure, con la quale si espongono tutte le varie misure previste dalla normativa della privacy; infine la gestione del rapporto di lavoro con cui vengono presentate le complesse modalità operative che attengono alle varie forme di tutela della riservatezza. However, recent measures to combat terrorism, to fight crime, and to increase security, together with the growing social acceptance of privacy-invasive technologies can be considered a serious threat to the fundamental right to privacy. What is the purport of ‘reasonable expectations of privacy’? Reasonable expectations of privacy and the reality of data protection is the title of a research project being carried out by TILT, the Tilburg Institute for Law, Technology, and Society at Tilburg University, The Netherlands. The project is aimed at developing an international research network of privacy experts (professionals, academics, policymakers) and to carry out research on the practice, meaning, and legal performance of privacy and data protection in an international perspective. Part of the research project was to analyse the concept of privacy and the reality of data protection in case law, with video surveillance and workplace privacy as two focal points. The eleven country reports regarding case law on video surveillance and workplace privacy are the core of the present book.
