Book Synopsis Modification of Treaties by Subsequent Practice by : Irina Buga
Download or read book Modification of Treaties by Subsequent Practice written by Irina Buga and published by Oxford University Press. This book was released on 2018-04-04 with total page 514 pages. Available in PDF, EPUB and Kindle. Book excerpt: While treaties can be notoriously difficult to amend by formal means, they must nevertheless be adapted over time in order to remain useful. Herein lies the role of subsequent practice as a key tool for treaty change. Subsequent practice-a well-established means of treaty interpretation-sometimes diverges from the original treaty provision to such an extent that it can no longer be said to constitute an act of interpretation or application. Rather, it becomes, in effect, one of treaty modification. The modification of treaties by subsequent practice extends to all fields of international law, from the law of the sea, environmental law, and investment law, to human rights and humanitarian law. Such modifications can have significant practical consequences, from revising or creating new rights and obligations, to establishing new institutional mechanisms. Determining when and how treaty modification by subsequent practice occurs poses difficulty to legal scholars and dispute settlement bodies alike, and impacts States' expectations as to their treaty obligations. This significant yet underexplored process is the focus of this book. Modification of Treaties by Subsequent Practice proves that subsequent practice can-under carefully defined conditions that ensure strict accordance with the will of the treaty parties-alter, supplement, and terminate treaty provisions or even entire treaty frameworks. It can also generate customary law and fuel regime interaction. Ultimately, this book demonstrates the relevance and dynamism of the process of treaty modification by subsequent practice, emphasizing the need to deal with the issue head on, and explains-on a theoretical and practical level-how it can be identified and dealt with more consistently in the future. The book thus contributes to a deeper understanding of the process of treaty modification by subsequent practice and its continued role in striking the judicious balance between the stability of treaties on the one hand, and the organic evolution of the law on the other.
Book Synopsis Asia-Pacific Diplomacy by : Lawrence T. Woods
Download or read book Asia-Pacific Diplomacy written by Lawrence T. Woods and published by UBC Press. This book was released on 1993-07-01 with total page 274 pages. Available in PDF, EPUB and Kindle. Book excerpt: The emergence of Asia-Pacific regionalism, as witnessed by the increasing influence of the Asia-Pacific Economic Cooperation forum and the annual ASEAN Post-Ministerial Conference, highlights one of the major trends in late twentieth-century geopolitics and international relations. Asia-Pacific Diplomacy traces the evolution of the Pacific economic cooperation movement by examining the diplomatic contributions of three international nongovernmental organizations (INGOs) -- the scholarly Pacific Trade and Development Conference (PAFTAD), the business-oriented Pacific Basin Economic Council (PBEC), and the multipartite (academic, business, and government) Pacific Economic Cooperation Council (PECC). Lawrence Woods also provides a historical perspective by assessing the work of the Institute of Pacific Relations, forerunner of the INGOs. This book makes an important contribution to the study of international political and economic institutions. It argues that as the regional cooperation movement expands at the governmental level. an understanding of the nongovernmental roots of that movement is required if the diplomatic contributions of the INGOs are to be retained.

Book Synopsis The Foundations of Modern Arms Control by : Robert M. Blum
Download or read book The Foundations of Modern Arms Control written by Robert M. Blum and published by Taylor & Francis. This book was released on 2024-04-30 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is an international history of the foundation of modern arms control, highlighting the fact that the instrument is varied, resilient, successful, and enduring. The narrative begins after the Napoleonic wars when newly arisen peace movements focused on arbitration as a path to “ending the war system.” It moves on to the international community’s embrace of “total and complete disarmament” and then to its acceptance of more limited measures by 1968, including the agreements that remain in force today. The book connects the past to the present of multiple negotiations, successful and failed, and underlines how the peace movement increasingly influenced the national policy of the major Western powers, especially the United States. It also highlights the increasing diversification of arms control players, including women and people of color as well as the countries they represented. Based on original research in multinational records and the latest scholarship, the book illustrates the reasons multilateral arms control remains a key instrument of international relations. The chapters are organized both chronologically and thematically, with the result that they cover different amounts of time in order to encompass a given issue and to capture the development of particular threads. The main narrative evolves into a decadeslong quest for a global treaty on “general and complete disarmament,” which otherwise paces the book and shapes its chapters. This book will be of much interest to students of arms control, global governance, peace studies, and International Relations.
