Book excerpt: The Pension Protection Fund offers protection to some 12.4 million pensioners in private sector defined benefit (often known as final salary) pension schemes should their employer become insolvent. The Fund currently manages its assets well and has not been exposed to severe losses in the recession. In 2008-09, the Fund's investments increased in value by 13.4 per cent. The Fund's standard investments saw a return of minus 3.4 per cent in 2008-09 (against the market average for the same combination of asset classes of minus 3.6 per cent). But, as the Fund's assets grow, the investment operation will require additional skills and the Fund should consider adapting its investment processes. The Fund's deficit increased during the recession - from £517 million in March 2008 to £1.2 billion in March 2009 - largely because of the combined deficit of the increased number of schemes being assessed on whether they should be transferred to the Fund. However, the value of the Fund's assets far outweighs its annual compensation payments: at the end of March 2009 its assets were £3.2 billion but its current compensation payments amount to £70 million a year. The Fund has developed a suitable model to assess future liabilities and this has proved resilient to a range of stress tests. The model's longer-term projections are sensitive to important assumptions, so the Fund should establish a framework for illustrating the sensitivity of output from its long-term risk model.

Examples of these regulatory offices include Oftel (telecommunications), Ofgas (gas supply), Offer, (electricity), Ofwat (water services) and Postcomm (postal services). Other regulatory offices with slightly different regulatory remits include the Civil Aviation Authority, the Financial Services Authority, the Pensions Regulator, the Competition Commission and the Office of Fair Trading. The Committee's report examines the statutory remits of the UK economic regulators, their working methods and working relationships, the value for money they provide and the extent to which the regulators have successfully promoted competition and de-regulated where possible, as well as considering whether they should be given an additional statutory duty to facilitate the competitiveness of UK firms. Overall, the Committee concludes that the legislation is working well, but that a greater standardisation of remits should be introduced over time to ensure all regulators are statutorily required to follow best practice. In most sectors, regulators have played an important role in helping to promote competition, with the exception of the water industry. The report explores possible reasons for the lack of competition in this sector, and urges Ofwat to take account of the general comments made by the Competition Appeal Tribunal on its access regime. It highlights the need for greater parliamentary oversight over regulatory bodies and recommends that a Joint Committee of both Houses be set up, or failing this, that a sessional Select Committee be established in the House of Lords.

This NAO report examines the regulatory approach taken and whether this addresses the key risks, given that any conclusions on the effectiveness of pensions regulation must be set in the long term context rather than based on shorter term fluctuations. Findings include that the Pensions Regulator has made good progress in establishing a sound risk-based approach to regulation, with clear links between its statutory objectives and its operational approach. As the regulator matures, it has the scope for a presumption of further transparency in its approach, and is taking steps to increase the information it makes available to the pensions sector. The report sets out a number of recommendations for further progress, bearing in mind that risks in the pensions environment can change quickly.

Chapter 1 explains the Ombudsman's role and jurisdiction and the background to the investigation. Chapter 2 details the complaints, and the Government's initial response; chapter 3 sets out the results of further enquiries to help understand the context of the complaints. The fourth chapter provides the evidence that the investigation has disclosed through consideration of departmental files, official publications and other documentary sources. Chapters 5 and 6 contain the findings and the recommendations. The seventh chapter gives the Ombudsman's assessment of the Government response (appendix D) to the report, and the final chapter is the Ombudsman's conclusion. The Ombudsman makes three findings of maladministration by public bodies: (i) official information about the security that members of final salary schemes could expect from the minimum funding requirement (MFR) was sometimes inaccurate, often incomplete, largely inconsistent and therefore potentially misleading; (ii) the response by DWP to the actuarial profession's recommendation that disclosure should be made to pension scheme members of the risks of wind-up and the risks to accrued pension rights; (iii) the decision in 2002 by DWP to approve a change to the MFR basis. This maladministration was a significant contributory factor in the creation of the financial losses suffered by individuals, amounting to injustice. Recommendations include restoration of the core pension and non-core benefits and some consolatory payments to those fully covered by the recommendations, an apology to scheme trustees for the effects of the maladministration, and a review with the pensions industry to improve the time taken to wind up schemes. The Government, however, is minded not to comply with all of the recommendations, and so the Ombudsman reports to both Houses of Parliament that she has identified injustice caused by maladministration which the Government does not propose to remedy.
