Es verdad que las leyes parten de este presupuesto desde hace bastante tiempo, pero ha sido a raíz de la del Patrimonio Histórico Español de 1985, fecundamente secundada por las aprobadas por las comunidades autónomas, cuando el mismo ha recibido un potente e inequívoco espaldarazo normativo llamado a desterrar definitivamente del concepto de Arqueología cualquier intervención que se no se ajuste a criterios científicos y a reservar el régimen jurídico del patrimonio arqueológico a los frutos de dicha actividad. De esta forma, dos ramas del saber muy distintas entre sí, la Arqueología y el Derecho, contribuyen cada una a su manera y con sus respectivos instrumentos a racionalizar y ordenar una materia cuya importancia trasciende de la satisfacción personal pues se inscribe en el plano de lo social. Un patrimonio que está llamado en última instancia, tras haber sido documentado y estudiado, a ser objeto de fruición colectiva, a ser conocido y comprendido por la ciudadanía, que tiene derecho a acceder a él y a conocer su significado. El objetivo del presente libro es explicar, en términos escuetos y sencillos, los fundamentos científicos de la Arqueología y de la investigación arqueológica, por un lado, y los aspectos más elementales del régimen jurídico del patrimonio arqueológico, por otro. Sus evidentes límites estructurales han obligado a dejar aparcado el tratamiento de muchos aspectos que los autores consideran relevantes desde su respectiva especialidad, en beneficio de una exposición didáctica y circunscrita a lo esencial en el sentido más estricto de la palabra.

Book excerpt: In Articulating the Ḥijāba, Mariam Rosser-Owen analyses for the first time the artistic and cultural patronage of the ‘Amirid regents of the last Cordoban Umayyad caliph, Hisham II, a period rarely covered in the historiography of al-Andalus. Al-Mansur, the founder of this dynasty, is usually considered a usurper of caliphal authority, who pursued military victory at the expense of the transcendental achievements of the first two caliphs. But he also commissioned a vast extension to the Great Mosque of Cordoba, founded a palatine city, conducted skilled diplomatic relations, patronised a circle of court poets, and owned some of the most spectacular objects to survive from al-Andalus, in ivory and marble. This study presents the evidence for a reconsideration of this period.
