El libro analiza el proceso de integración de las instituciones de participación directa -referéndum e iniciativa popular-, en la evolución del Estado constitucional, desde las primeras expresiones del constitucionalismo francés y americano hasta la implantación de la democracia constitucional en las Repúblicas de Europa central y oriental en la última década del siglo pasado. Asumiendo que los fundamentos básicos de la democracia constitucional pueden superar los límites del Estado y adaptarse a una comunidad política supranacional como la Unión Europea, la investigación también se ocupa de identificar las oportunidades de participación directa del ciudadano europeo en la vida democrática de la Unión (diálogo civil, consultas, iniciativa ciudadana europea). La investigación incide de manera especial en aquellas instituciones de participación directa cuyo ejercicio práctico depende de la iniciativa del propio ciudadano. Entre las diversas variantes de iniciativa ciudadana en derecho constitucional comparado se presta una atención preferente a la iniciativa popular de la Confederación Suiza, a las variantes de iniciativa popular reguladas en las Constituciones de los Estados de California y Massachusetts, y a las iniciativas populares para la proposición de leyes ante el parlamento italiano y español. Por último, el análisis jurídico de la iniciativa legislativa popular española se acompaña de un análisis empírico que examina la evolución del número de iniciativas presentadas ante las Cortes Generales y el conjunto de los parlamentos autonómicos, la distribución de las iniciativas presentadas entre los parlamentos autonómicos, el tipo de materia en la que inciden las demandas legislativas planteadas y los resultados de la tramitación de los expedientes parlamentarios de las proposiciones de ley de iniciativa ciudadana. Los resultados obtenidos evidencian que esta institución resulta esencialmente ineficaz para la juridificación de las demandas normativas de los ciudadanos. Por ello, el libro sugiere algunas ideas básicas que deberían considerarse en una eventual reforma normativa orientada a dotar de una mayor funcionalidad a la iniciativa ciudadana española.

Igualmente, se propone la introducción de modernas atribuciones, bien ancilares de las anteriores, como la incorporación de las TIC a la potenciación de la participación, o, funciones ex novo, como la función integradora y la pedagógica.Como colofón, se emprende el estudio de los mecanismos de participación vigentes en el ordenamiento jurídico español a fin de plantear una sugestiva reflexión, crítica y razonada, acerca de la introducción de eventuales reformas legislativas para asegurar una participación de los ciudadanos, viable y compatible, en una democracia esencialmente representativa. En esta línea, se hacen propuestas de lege ferenda relativas a los principales problemas a los que se enfrenta nuestro país y circunscritas a la incorporación de nuevas vías de participación conciliables con la democracia representativa fundamentalmente vinculadas con la Revolución Digital, la reforma de los instrumentos de participación previstos en la Constitución Española y la integración de mecanismos trasladados desde el derecho comparado como las Convenciones Constitucionales.
