Available in PDF, EPUB and Kindle. Book excerpt: This is the first anthology to take a theoretical look at violence against women. Each essay shows how philosophy provides a powerful tool for examining a difficult and deep-rooted social problem. Stanley G. French, Wanda Teays, and Laura M. Purdy, all philosophers, present a familiar phenomenon in a new and striking fashion. The editors employ a two-tiered approach to this vital issue. Contributors consider both interpersonal violence, such as rape and battering; and also systemic violence, such as sexual harassment, pornography, prostitution, and violence in a medical context. The editors have further broadened the discussion to include such cross-cultural issues as rape in war, dowry deaths, female genital mutilation, and international policies on violence against women. Against this wide range of topics, which integrate personal perspectives with the philosophical, the contributors offer powerful analyses of the causes and effects of violence against women, as well as potential policies for effecting change.

Available in PDF, EPUB and Kindle. Book excerpt: In Governing with the Charter, James Kelly clearly demonstrates that our current democratic deficit is not the result of the Supreme Court’s judicial activism. On the contrary, an activist framers’ intent surrounds the Charter, and the Supreme Court has simply, and appropriately, responded to this new constitutional environment. While the Supreme Court is admittedly a political actor, it is not the sole interpreter of the Charter, as the court, the cabinet, and bureaucracy all respond to the document, which has ensured the proper functioning of constitutional supremacy in Canada. Kelly analyzes the parliamentary hearings on the Charter and also draws from interviews with public servants, senators, and members of parliament actively involved in appraising legislation to ensure that it is consistent with the Charter. He concludes that the principal institutional outcome of the Charter has been a marginalization of Parliament and that this is due to the Prime Minister’s decision on how to govern with the Charter.

Book excerpt: Every year, over 1.3 million people apply to visit, work, or settle in Canada. It falls to visa officers to determine who gets in – and who stays out. In the face of this enormous responsibility, how do these gatekeepers use their discretionary authority to assess eligibility, credibility, and risk? Seeking answers to this question, Vic Satzewich conducted interviews with 128 visa officers, locally engaged staff, and immigration program managers at eleven overseas offices. He reveals how the organizational context within which they work shapes their decision making. When something in an application does not “add up” – somber photographs from a supposed wedding celebration, for example – an officer conducts follow-up interviews with the applicant. In a world where no two visa applications are the same, and in the context of complex and shifting population movements and pressures, this is a fascinating look at how visa officers do their work.

Book excerpt: Canada’s history, since its birth as a nation one hundred and fifty years ago, is one of immigration, nation-building, and contested racial and ethnic relations. In Immigration, Racial and Ethnic Studies in 150 Years of Canada: Retrospects and Prospects scholars provide a wide-ranging overview of this history with a core theme being one of enduring racial and ethnic conflict and inequality. The volume is organized around four themes where in each theme selected racial and ethnic issues are examined critically. Part 1 focuses on the history of Canadian immigration and nation-building while Part 2 looks at situating contemporary Canada in terms of the debates in the literature on ethnicity and race. Part 3 revisits specific racial and ethnic studies in Canada and finally in Part 4 a state-of-the-art is provided on immigration and racial and ethnic studies while providing prospects for the future. Contributors are: Victor Armony, David Este, Augie Fleras, Peter R. Grant, Shibao Guo, Abdolmohammad Kazemipur, Anne-Marie Livingstone, Adina Madularea, Ayesha Mian Akram, Nilum Panesar, Yolande Pottie-Sherman, Paul Pritchard, Howard Ramos, Daniel W. Available in PDF, EPUB and Kindle. Book excerpt: This book provides an analytic framework from which the foundation of ideological perspectives, administrative structures, and substantive issues are explored. Departing from traditional approaches that emphasize a single discipline or perspective, it offers an interdisciplinary framework with which to think through ecological, political, economic, and social issues. It also provides a multi-stage analysis of policy making from agenda setting through the evaluation process. The integration of social science perspectives and the combination of theoretical and empirical work make this innovative book one of the most comprehensive analyses of Canadian natural resource and environmental policy to date.

The authors of this book have conducted extensive research into the nature and function of appeal courts and here present their findings. This book outlines how appeal court judges make their decisions and how they defend them; the role played by judicial discretion; regional differences in appeal court operations; and the increasingly controversial role courts play in policymaking. Final Appeal is a detailed analysis of the nature and operation of Canada's courts of appeal.

Book excerpt: Disabling Barriers analyzes issues relating to disability at different moments in Canadian and American history. In this volume, legal scholars, historians, and disability-rights activists demonstrate that disabled people can change their social status by transforming the political and legal discourse surrounding disablement. Employing tools from the fields of law and history, this original contribution explores how disabled people have been portrayed and treated in a variety of contexts, including within the labour market, the workers’ compensation system, the immigration process, and the legal system (both as litigants and as lawyers). It deepens our knowledge of the role of people with disabilities within social movements in disability history. The contributors encourage us to rethink our understanding of both the systemic barriers disabled people face and the capacity of disabled people to effect positive societal change.
