This book was released on 2015 with total page 21 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report provides an overview of the outcome of a series of audits carried out by the Food and Veterinary Office (FVO) in 19 Member States (MSs) of the European Union (EU) between January 2012 and June 2014. This was the fourth series of FVO audits in this area. The objective of the audits was to evaluate the control systems in place for pesticides, in particular, the implementation of requirements for the authorisation of plant protection products (PPPs) and official controls on the marketing and use of PPPs under Regulation (EC) No 1107/2009 and Directive 2009/128/EC, and the implementation of the requirements for official controls of PPPs at growers, as specified in Regulation (EC) No 882/2004.^While there were systems and procedures for the authorisation of PPPs in place in all Member States, related shortcomings were identified in two areas: (a) Delays with re-authorisations of PPPs under Directive 91/414/EEC, and with mutual recognitions under Regulation (EC) No 1107/2009: Many authorised PPP had not been evaluated to EU standards, more than 15 years after the principles for evaluation had been established. Similarly, delays and problems with cooperation between Member States were identified for the zonal authorisation system under Regulation (EC) No 1107/2009. This highlights the difficulty of MSs to implement authorisation systems based on EU legislation; (b) Emergency authorisations of PPPs under Regulation (EC) No 1107/2009: The report identifies problems with misuse of emergency authorisations for minor uses of PPPs, but also for other use extensions of approved PPPs.^In addition, emergency authorisations for the same products have been granted for consecutive years, thus undermining the effectiveness of the strict criteria for regular authorisations established by EU legislation. Systems were in place for official controls on the marketing and use of PPPs. One common weakness in controls at both market and user level, was the coverage of operators. With regard to official controls on the marketing of PPPs, there were further weaknesses related to unsatisfactory labelling checks and unsatisfactory quality controls of pesticides. As a consequence, there was insufficient assurance that counterfeit and illegal pesticides would be detected. In general, official controls on the use of PPPs were more effective than controls on the marketing of PPPs.^In most of the MSs visited, all relevant aspects were covered during inspections and comprehensive checks of records kept by professional users were taking place, which provided guarantees that PPPs are applied in accordance with the conditions specified on the labels. Weaknesses were identified with regard to prioritisation of official controls. Co-ordination and co-operation between and, in some cases, within CAs was considered to be weak. Initial measures were adequately put into place for the implementation of Directive 2009/128/EC, in particular, training and certification of professional users, safe handling and storage of PPPs, their containers and remnants, Integrated Pest Management (IPM) and application equipment. This is a step forward to ensure the sustainable use of pesticides. Good practices were found with regard to systems for official controls as a whole, or certain aspects. These are described in the relevant chapters of the report.

While weaknesses were found in controls on the marketing of plant protection products in many Member States, controls on the use of plant protection products were generally satisfactory.

Book excerpt: The Commission carried out a series of audits in 25 Member States between 2016 and 2018 to examine what measures Member States have put in place to audit their national control systems to ensure the safety of feed and food. On the whole, the report concludes that whilst all Member States were carrying out audits, and that these audits could lead to improvements in the official controls of feed and food, the impact of these audits very much depended on strong management commitment to follow up on the results. Some challenges remain, in particular with regard to the independent scrutiny of the audit process.

Book excerpt: This report describes the main conclusions in relation to a series of 10 audits carried out in Member States during 2016, with the objective of evaluating the systems put in place to implement Article 4(6), on audits of competent authorities, of Regulation (EC) No 882/2004 of the European Parliament and of the Council. It was found that those competent authorities that had effectively implemented audits of official controls could demonstrate that their audit process contributed to ensuring the quality, and improving the consistency and effectiveness of official controls, provided that there was strong management commitment to the follow-up of audit recommendations. Some challenges remain in ensuring that audit arrangements are optimised to provide credible, reliable results that have a positive impact on the effectiveness and consistency of official controls. In particular some competent authorities had not yet fully addressed the requirements for independent scrutiny of the audit process and effective follow-up of audit results.

Book excerpt: This report covers the overall operation of EU countries' official controls and the Commission control activities carried out in 2019 and 2020 to ensure a high level of health protection and trust in the food chain, from farm to fork. These controls and audits are important to verify that businesses are complying with the legal requirements and so that European consumers can be confident that the food they consume is safe. They are also key to enabling the smooth operation of safe trade in food, animals and plants, both within the EU and with non-EU countries. National authorities are responsible for carrying out official controls based on risk. If businesses along the food chain do not comply with the relevant legislation, the authorities are required to enforce the requirements, ensuring that businesses meet these. The Commission services control EU countries' implementation of official controls and enforcement activities. The reports from these controls, published on the Commission's website, provide a clear picture of EU countries' performance and are a significant part of the review process that ensures EU legislation is 'fit for purpose'.

Book excerpt: This report provides an overview of a European Commission project on import controls for plant health. The objectives of the project were to evaluate Member States' capacity and performance of import controls on plant health, to identify and promote best practice across the Union, and to support the development of implementing legislation under the new Plant Health Law and Official Controls Regulation. The project did not find any significant shortcomings with import control procedures for plant health, but identified substantial differences between Member States in their capacity and implementation of import checks. The report highlights some of the many examples of good practice and critical points that were identified by the project and the action taken subsequently by the Commission and Member States during the development of the new plant health regime.

Book excerpt: This book explores the regulation of pesticides in the European Union in order to reveal the complex, controversial, and contested nature of an assessment system proudly declared by the EU to be ‘the strictest in the world’. The current regulatory framework is based on Regulation 1107/2009, which substantially reformed the previous system. The analysis describes the new criteria and procedures for the authorization of active substances to be used in the production of pesticides, traces the lengthy policy formulation process, and identifies factors that made policy change possible. Further, the book illustrates the current controversies that characterise the implementation of Regulation 1107/2009: the ban of pesticides harmful to pollinators, the renewal of the authorization of glyphosate, and the definition of criteria for the assessment of endocrine disruption. The author provides information on policy outcomes and highlights persisting shortcomings in the enforcement of EU regulation. This book will appeal to students and scholars from a variety of disciplines, including political science, political sociology, and public policy.

Book excerpt: Plant health is of crucial importance for sustainable agriculture, food security and environmental protection. It is constantly exposed to new and emerging risks, resulting from the rapidly increasing global trade in plants and plant products and climate change, and illustrated by the frequent findings of new harmful organisms by Member States on plants and plant products imported into the EU, and on the Union territory. The European Union's (EU) plant health system aims to minimise and manage these risks, using a combination of prohibitions and specific control measures. This report provides an overview of a project carried out by the European Commission's Directorate General for Health and Food Safety, to evaluate the measures in place to identify and respond to new and emerging risks to plant health and highlights the critical points and many examples of good practice that were identified for ensuring the effective control of such risks.

Book excerpt: This report covers the overall operation of EU countries' official controls and the Commission's control activities in 2021. These controls aim to ensure a high level of health protection and trust in the food chain, from farm to fork. They are an important way to verify that businesses are complying with their legal requirements so that EU consumers can be confident that the food they eat is safe. They are also key to enabling the smooth operation of safe trade in food, animals and plants, both within the EU and with non-EU countries. National authorities are responsible for carrying out official controls. If businesses along the food chain do not comply with the relevant legislation, the national authorities are required to enforce the requirements, ensuring that businesses meet their obligations. In 2021, there were 16.9 million entities within the scope of official controls and national authorities carried out nearly 5 million official controls on them. Based on these controls, around 1 million non-compliance issues were identified, leading to the application of nearly 500 000 administrative sanctions and almost 8 000 judicial actions. The Commission verifies the EU countries' implementation of official controls and enforcement activities. The reports from these Commission controls, which are published on the Commission's website, provide a clear picture of national authorities' performance and are a significant part of the review process that ensures that EU legislation is fit for purpose.

Book excerpt: This report provides an overview about the functioning of the EU Plant Protection Product authorisation process in several EU Member States and if it is in line with requirements laid down in Regulation (EC) No 1107/2009. The purpose of this regulation is to ensure a high level of protection of both human and animal health and the environment. It sets out the requirements, procedure and timeframes for authorisation of Plant Protection Products and established a zonal system of authorisation in the EU to enable a harmonised and efficient system to operate. The report finds that the zonal system laid down in the Regulation is not working effectively and deadlines for authorisation are not met by the majority of Member States as they do not avail of the opportunities to share work among them and they have not taken measures to compensate this lack of work sharing. As a result, the objective of the Regulation to ensure a high level of protection of both human and animal health and the environment and to improve the functioning of the internal market in the Member States is undermined.

Book excerpt: There is an increasing demand, not only within the European Community, for meaningful and accurate information on the consumption and use patterns of plant protection products. This publication presents the second update of the report from Eurostat on 'The use of plant protection products in the European Union', including for the first time figures for the ten new Member States for the four years preceding their accession to the EU in 2004. It provides statistical information on the estimated consumption of plant protection products, broken down by Member States, treated crops, chemical classes and active substances. Meaningful and reliable data on the use of plant protection products are necessary to monitor the risks related to their use, in particular the risks for the environment. Such data will become an essential tool to measure the progress of the Thematic Strategy on the Sustainable Use of Pesticides recently proposed by the Commission for adoption by the Council and the Parliament. Before official statistics on the use of plant protection products are delivered by the Member States on a mandatory basis, the estimations of use provided by the European Crop Protection Association (ECPA) are very useful since they are the only detailed data available at crop and active substance level; with the exception of the very few official surveys carried out in some Member States.

Book excerpt: Scores of talented and dedicated people serve the forensic science community, performing vitally important work. However, they are often constrained by lack of adequate resources, sound policies, and national support. It is clear that change and advancements, both systematic and scientific, are needed in a number of forensic science disciplines to ensure the reliability of work, establish enforceable standards, and promote best practices with consistent application. Strengthening Forensic Science in the United States: A Path Forward provides a detailed plan for addressing these needs and suggests the creation of a new government entity, the National Institute of Forensic Science, to establish and enforce standards within the forensic science community. The benefits of improving and regulating the forensic science disciplines are clear: assisting law enforcement officials, enhancing homeland security, and reducing the risk of wrongful conviction and exoneration. Strengthening Forensic Science in the United States gives a full account of what is needed to advance the forensic science disciplines, including upgrading of systems and organizational structures, better training, widespread adoption of uniform and enforceable best practices, and mandatory certification and accreditation programs. While this book provides an essential call-to-action for congress and policy makers, it also serves as a vital tool for law enforcement agencies, criminal prosecutors and attorneys, and forensic science educators.
