Download or read book Shaping US Military Law written by Joshua E. Kastenberg and published by Routledge. This book was released on 2016-04-01 with total page 447 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the United States’ entry into World War II, the federal judiciary has taken a prominent role in the shaping of the nation’s military laws. Yet, a majority of the academic legal community studying the relationship between the Court and the military establishment argues otherwise providing the basis for a further argument that the legal construct of the military establishment is constitutionally questionable. Centering on the Cold War era from 1968 onward, this book weaves judicial biography and a historic methodology based on primary source materials into its analysis and reviews several military law judicial decisions ignored by other studies. This book is not designed only for legal scholars. Its intended audience consists of Cold War, military, and political historians, as well as political scientists, and, military and national security policy makers. Although the book’s conclusions are likely to be favored by the military establishment, the purpose of this book is to accurately analyze the intersection of the later twentieth century’s American military, political, social, and cultural history and the operation of the nation’s armed forces from a judicial vantage.

Available in PDF, EPUB and Kindle. Book excerpt: The topic of civil-military relations has high significance for academics, for policy makers, for military commanders, and for serious students of public policy in democratic and other societies. The post-Cold War and post-9-11 worlds have thrown up traditional as well as new challenges to the effective management of armed forces and defense establishments. Further, the present century has seen a rising arc in the use of armed violence on the part of non-state actors, including terrorists, to considerable political effect. Civil-military relations in the United States, and their implications for US and allied security policies, is the focus of most discussions in this volume, but other contributions emphasize the comparative and cross-national dimensions of the relationship between the use or threat of force and public policy. Authors contributing to this study examine a wide range of issues, including: the contrast between theory and practice in civil-military relations; the role perceptions of military professionals across generations; the character of civil-military relations in authoritarian or other democratically-challenged political systems; the usefulness of business models in military management; the attributes of civil-military relations during unconventional conflicts; the experience of the all-volunteer force and its meaning for US civil-military relations; and other topics. Contributors include civilian academic and policy analysts as well as military officers with considerable academic expertise and experience with the subject matter at hand.

Available in PDF, EPUB and Kindle. Book excerpt: Anytime the use of US Armed Forces in support of civil authorities is considered, government and military leaders, pundits, and citizens reflexively turn to the Posse Comitatus Act for guidance. Since 9/11, the US Armed Forces face an increased likelihood that they will be called on to participate in actions typically viewed as civil matters. Many have also called for an increased role for the US Armed Forces in responding to natural disasters. Though many constitutional provisions, laws, and legal rulings govern this question, in the minds of many, the Posse Comitatus Act has prominence. Most individuals think they know what the Posse Comitatus Act allows and disallows; most of them are wrong.

Book excerpt: A diverse group of contributors offer different perspectives on whether or not the different experiences of our military and the broader society amounts to a "gap"—and if the American public is losing connection to its military. They analyze extensive polling information to identify those gaps between civilian and military attitudes on issues central to the military profession and the professionalism of our military, determine which if any of these gaps are problematic for sustaining the traditionally strong bonds between the American military and its broader public, analyze whether any problematic gaps are amenable to remediation by policy means, and assess potential solutions. The contributors also explore public disengagement and the effect of high levels of public support for the military combined with very low levels of trust in elected political leaders—both recurring themes in their research. And they reflect on whether American society is becoming so divorced from the requirements for success on the battlefield that not only will we fail to comprehend our military, but we also will be unwilling to endure a military so constituted to protect us. Sugarman, Lindsay Cohn Warrior, Benjamin Wittes

This book was released on 2020-12-23 with total page 244 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The interaction between military and civilian courts, the political power that legal prerogatives can provide to the armed forces, and the difficult process civilian politicians face in reforming military courts remain glaringly under-examined. This book fills a gap in existing scholarship by providing a theoretically rich, global examination of the operation and reform of military courts in democracies. Drawing on a newly-created global dataset, it examines trends across states and over time. Combined with deeper qualitative case studies, the book presents clear and well-justified findings that will be of interest to scholars and policymakers working in a variety of fields"--
