The interchangeable terms trafficking and modern slavery evoke emotive responses and proclamations about abolition of contemporary ills, viewed as the ultimate aberration when a child is involved. The classification of children under legal frameworks marks them as different, as 'other', and in the context of laws implemented to address trafficking, slavery, and children on the move more generally, this distinction is complicated. This book charts the emergence, decline and re-emergence of child trafficking law and policy during the twentieth and twenty-first centuries. It provides a systematic and comprehensive overview of the historical origins of child trafficking by utilising the wealth of information located within the non-digitised archives of the League of Nations. It focusses upon the Committee on the Traffic in Women and Children to engage with League of Nations policy to provide an insightful and original contribution to the current body of literature. This is a book that seeks to critique the entanglements of children's rights and colonialism in relation to the mobility and exploitation of children. It centralises the legacy of colonialism, the undercurrents of race, white supremacy, patriarchy, and their ongoing influence upon contemporary anti-trafficking legal and policy responses. Through utilizing what the author identifies as the 'anti-trafficking machine' as a theoretical framework, the book challenges contemporary law and policy responses to child trafficking. This theoretical framework has been adopted to illustrate a central hypothesis of the book - that the contemporary anti-trafficking agenda is both imperialist and a continuity of colonial attitudes. Elizabeth A. Faulkner is Lecturer in Law at Keele University, United Kingdom. Human trafficking is a major concern not only intra-country but also inter-country. The aim of this paper is to identify the problem and suggest ways to a better solution. The first topic is a brief history in which the genesis of adoption is explained, and it is discussed whether adoption is really for the welfare of the child. Furthermore, the relationship between inter-country adoption and India is explained. It is analysed, what laws provide such kind of adoptions, what is lacking in those laws, what their impact is and if the adoption is really happening in the country. Additionally, the international laws of adoption and whether they help in protecting the interest of the child are discussed. Then, the problem of child trafficking based on illegal adoption, how far the laws dealt with it, what has to be done and how to protect children from such abuses is explained. There must be a strong, stable and legitimate inter-country adoption infrastructure. Adoption can only maintain a principled and enforceable line against child selling and child trafficking when effective systems of enforceable regulation are in place that effectively prevent adoption systems from becoming markets for children. The refusal or failure of the domestic and inter-country adoption systems to put those needed regulations into place speaks volumes regarding the ethics of the domestic and inter-country adoption. Inter-country adoption is a conditional good; inter-country adoption as child trafficking is an evil.

Trafficking implicates civil and political rights, including freedom of movement, the right to be free from cruel and degrading treatment, and the right to be free from slavery and slavery-like practices. Trafficking is also deeply connected to the deprivation of economic, social and cultural rights. Though a number of treaties and UN resolutions address trafficking, it is apparent that there is a wealth of words on paper but a glaring lack of enforcement. This situation is due in large part to substantive and structural weaknesses in the relevant instruments, as well as to powerful economic and social forces and a corresponding lack of political will. The anti-trafficking measures, after all, are aimed at protecting one of the most marginalized populations in the world, a population from which many individuals and even national economies profit. Both treaty law and UN Charter-based human rights mechanisms offer advocates opportunities to press for the implementation of the prohibition of trafficking in people for prostitution. This article provides an overview and analysis of these treaties and mechanisms. Though many of them are weak, some have the ability to generate pressure and help create the political will necessary for change. The article first discusses international treaties on trafficking and slavery, as well as the relevant ILO treaties. Next, the UN human rights treaties are addressed, followed by discussion of UN Charter-based mechanisms, and the quot;soft lawquot; on trafficking. The article concludes by recommending which mechanisms would be of the most use in making the international law against trafficking for prostitution live up to its potential.

The Palermo Protocol made a good start and has widespread support. The Council of Europe Convention tries to go further, and includes monitoring and accountability mechanisms. In order to evaluate and reconsider the present anti-trafficking legislation these two international anti-trafficking documents are compared in this work in order to find the best strategy to combat trafficking in children. It is argued that the Council of Europe Convention is not a perfect anti-trafficking instrument either but due to its special measures it offers more protection to children. Thus, it can be taken as a starting point for the 'rebuilding' the international legal system for preventing and combating trafficking in children, and for new national laws as well. This legal analysis suggests that the natural progression of anti-trafficking legislation includes the accelerating adoption of national laws enabling, facilitating, and mandating focused law enforcement campaigns against human trafficking of the most vulnerable victims, our children.

Book excerpt: Whilst the value of human integrity within the laws of individual states and the documents of international human rights is being increasingly consolidated and will become, sooner or later, the primary concern of the law, severe breaches of this value are indeed still widespread. In particular the sexual exploitation of children constitutes one of the most serious questions of national, regional, transnational and international law. According to international records, every fifteen seconds a child is raped in Africa alone. Almost half of the cases heard by the ICTY concern the sexual exploitation of women and children during armed conflict. More or less similar conclusions may be reached regarding the ICTR or the SCSL. In Rwanda alone, 500,000 females were raped. Almost 200,000 females and children have been the victims of cruel forms of sexual violence during the conflicts in Congo. Sexual abuse of children by priests cannot any longer be concealed in Australia, Belgium, Canada, Germany, France, Ireland, Mexico, the United Kingdom, and the United States, although it is ignored in most Islamic countries. The sexual exploitation of children is also widely practised in many other countries. Regrettably, 79% of all world trafficking is for sexual exploitation. The principal subject matter of this book is the legal etymology of sexual exploitation governing minors. The aim is to identify and analyse jus cogens and obligation erga omnes in relation to the sexual exploitation of children and to evaluate the international responsibility of states in relation to the elimination or prevention of the crime, and the prosecution and punishment of offenders.

Yet, while efforts both on a European as well as international level, aim to combat and eradicate this heinous crime, reality depicts a worldwide rise in THB. Trafficking in Human Beings is a truly lucrative business for the perpetrators of organized crime, whilst predominantly targeting the most vulnerable groups in society. The European and international discourse on Trafficking in Human Beings has recognized that the previous criminal law approach to THB in some countries is ineffective in combating this crime. This is evident in the global rise of THB. The criminal law approach, with a narrow focus on the prosecution of perpetrators, disregarded the plight of the victims of THB and their highly vulnerable position. Thus an increased focus has been given to a comprehensive approach to trafficking in human beings, which must implement a human rights based approach, in order to place the victims at the center of focus, whilst aiming to strengthen their position and protection. The 2010 judgment of Rantsev v Cyprus and Russia at the European Court of Human Rights (ECtHR) reflects the discourse on a more comprehensive approach to Trafficking in Human Beings and was a watershed as regards the positive obligations of state parties, in combating THB. In its landmark judgment in Rantsev, the European Court of Human Rights broadly extended the positive obligations of states, party to the European Convention on Human Rights and Fundamental Freedoms (ECHR) under its Article 4.Article 4 provides safeguards against slavery, servitude and forced or compulsory labour.Article 4 does not mention Trafficking in Human Beings but was established to fall within the
