Book excerpt: The Inka Empire stretched over much of the length and breadth of the South American Andes, encompassed elaborately planned cities linked by a complex network of roads and messengers, and created astonishing works of architecture and artistry and a compelling mythology—all without the aid of a graphic writing system. Instead, the Inkas' records consisted of devices made of knotted and dyed strings—called khipu—on which they recorded information pertaining to the organization and history of their empire. Despite more than a century of research on these remarkable devices, the khipu remain largely undeciphered. In this benchmark book, twelve international scholars tackle the most vexed question in khipu studies: how did the Inkas record and transmit narrative records by means of knotted strings? The authors approach the problem from a variety of angles. Several essays mine Spanish colonial sources for details about the kinds of narrative encoded in the khipu. Others look at the uses to which khipu were put before and after the Conquest, as well as their current use in some contemporary Andean communities. Still others analyze the formal characteristics of khipu and seek to explain how they encode various kinds of numerical and narrative data.

Simonsohn examines the legislative response of Christian and Jewish religious elites to the problem posed by the appeal of their coreligionists to judicial authorities outside their communities. Focusing on the late seventh to early eleventh centuries in the region between Iraq in the east and present-day Tunisia in the west, Simonsohn explores the multiplicity of judicial systems that coexisted under early Islam to reveal a complex array of social obligations that connected individuals across confessional boundaries. By examining the incentives for appeal to external judicial institutions on the one hand and the response of minority confessional elites on the other, the study fundamentally alters our conception of the social history of the Near East in the early Islamic period. Contrary to the prevalent scholarly notion of a rigid social setting strictly demarcated along confessional lines, Simonsohn's comparative study of Christian and Jewish legal behavior under early Muslim rule exposes a considerable degree of fluidity across communal boundaries. This seeming disregard for religious affiliations threatened to undermine the position of traditional religious elites; in response, they acted vigorously to reinforce communal boundaries, censuring recourse to external judicial institutions and even threatening transgressors with excommunication.

Book excerpt: Exploring the lively polemics among Jews, Christians, and Muslims during the Middle Ages, Hava Lazarus-Yafeh analyzes Muslim critical attitudes toward the Bible, some of which share common features with both pre-Islamic and early modern European Bible criticism. Unlike Jews and Christians, Muslims did not accept the text of the Bible as divine word, believing that it had been tampered with or falsified. This belief, she maintains, led to a critical approach to the Bible, which scrutinized its text as well as its ways of transmission. In their approach Muslim authors drew on pre-Islamic pagan, Gnostic, and other sectarian writings as well as on Rabbinic and Christian sources. Elements of this criticism may have later influenced Western thinkers and helped shape early modern Bible scholarship. Nevertheless, Muslims also took the Bible to predict the coming of Muhammad and the rise of Islam. They seem to have used mainly oral Arabic translations of the Hebrew Bible and recorded some lost Jewish interpretations. In tracing the connections between pagan, Islamic, and modern Bible criticism, Lazarus-Yafeh demonstrates the importance of Muslim mediation between the ancient world and Europe in a hitherto unknown field. The studies brought together in this volume provide an important contribution to the history of ḏimmī-s in the medieval dār al-islām, and more generally to the legal history of religious minorities in medieval societies. The central question addressed is the legal status accorded to ḏimmī-s (Jews and Christians) in the Muslim law in the medieval Muslim west (the Maghreb and Muslim Spain). The scholars whose work is brought together in these pages have dealt with a rich and complex variety of legal sources. Many of the texts are from the Mālikī legal tradition; they include fiqh, fatwā-s, ḥisba manuals. These texts function as the building blocks of the legal framework in which jurists and rulers of Maghrebi and Peninsular societies worked. The very richness and complexity of these texts, as well as the variety of responses that they solicited, refute the textbook idea of a monolithic ḏimmī system, supposedly based on the Pact of 'Umar, applied throughout the Muslim world. In fact when one looks closely at the early legal texts or chronicles from both the Mashreq and the Maghreb, there is little evidence for a standard, uniform ḏimmī system, but rather a wide variety of local adaptations. Book excerpt: From the point of view of economic history, the ideal way to study any institution of commercial law would be to compare the information contained in legal codes and treatises with the material relating to its application in economic life as manifested by actual contracts, letters, and business records found in archives and other repositories. In the case of the early centuries of the Islamic period, available sources unfortunately preclude such a procedure. Theoretical legal texts exist in abundance, but any corresponding documentary material is for all practical purposes non-extant. In order to determine if the framework in which the trade and commerce of the early Islamic period was carried on--a trade known to have been active and important--we must of necessity rely on legal treatises for most of our information, which trying wherever possible to call upon whatever meager help other literary sources may provide. In the absence of documentary and similar sources, the possibility of investigating the quantitative aspects of trade is all but eliminated. However, in those areas of trade which have been described as qualitative, such as the variety of goods exchanged, the specialization of the merchant class, and the complexity of business methods, legal and other literary sources provide a great deal of valuable information. It is with the institutions of partnership and commenda in the early Islamic period, two of the qualitative components of trade, that Abraham L. Udovitch makes his primary focus in Partnership and Profit in Medieval Islam.
