Book Synopsis The Ombudsman Enterprise and Administrative Justice by : Trevor Buck
Download or read book The Ombudsman Enterprise and Administrative Justice written by Trevor Buck and published by Routledge. This book was released on 2016-02-17 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: The statutory duty of public service ombudsmen (PSO) is to investigate claims of injustice caused by maladministration in the provision of public services. This book examines the modern role of the ombudsman within the overall emerging system of administrative justice and makes recommendations as to how PSO should optimize their potential within the wider administrative justice context. Recent developments are discussed and long standing questions that have yet to be adequately resolved in the ombudsman community are re-evaluated given broader changes in the administrative justice sector. The work balances theory and empirical research conducted in a number of common law countries. Although there has been much debate within the ombudsman community in recent years aimed at developing and improving the practice of ombudsmanry, this work represents a significant advance on current academic understanding of the discipline.
Book Synopsis Ombudsman as a Global Institution by : Tero Erkkilä
Download or read book Ombudsman as a Global Institution written by Tero Erkkilä and published by Springer Nature. This book was released on 2020-02-27 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the ombudsman as a global institution. It has spread all over the world and its institutional development is increasingly being governed transnationally. Initially an institution of administrative law, the ombudsman has become a human rights institution and institution of good governance. These ideational shifts have influenced the global diffusion of the ombudsman but also the way in which this institution of accountability functions. The ombudsman is a peculiar institution of public accountability - both an institution and individual - that observes changes in the general political climate and engages in renegotiations of its intra-institutional position. The global models associated with the ombudsman are a source of organizational ideas, legitimacy, and sense of orientation, but they treat institutional actors differently, working also as mechanisms of inclusion and exclusion. The book tracks the global diffusion and institutional evolution of the ombudsman. Its chapters on institutional cases further explore the joint institutional history of the Parliamentary Ombudsman and the Chancellor of Justice in Finland, and the European Ombudsman.

Book Synopsis Public services ombudsmen by : Great Britain: Law Commission
Download or read book Public services ombudsmen written by Great Britain: Law Commission and published by The Stationery Office. This book was released on 2011-07-13 with total page 94 pages. Available in PDF, EPUB and Kindle. Book excerpt: The public services ombudsmen provide a vital redress mechanism for aggrieved citizens; they are free for complainants, confidential and swift. This report deals with the five public services ombudsmen operating in England and Wales: (1) The Parliamentary Commissioner; (2) The Local Government Ombudsman; (3) The Health Service Ombudsman; (4) The Public Services Ombudsman for Wales; and (5) The Housing Ombudsman. The overarching aim is to recommend modernisation of the statutes for these ombudsmen: clarifying them where required; reforming them where the Commission thinks this would facilitate the work of the ombudsmen; increasing transparency and accountability where necessary. The Commission could not consider fundamental institutional design, and did not look at the creation of new ombudsmen or the amalgamation of the existing ombudsmen. The subject matter of the ombudsmen's work or the definition of "maladministration" was also not considered. The report is divided in to 5 parts including the recommendation to commission a general review of the role of the public services ombudsmen and their relationship with other institutions for administrative justice, such as judicial review or tribunals; access to the ombudsmen; the ombudsmen process; resolution, report & sharing experience; and independence & accountability

Book Synopsis A Manifesto for Ombudsman Reform by : Richard Kirkham
Download or read book A Manifesto for Ombudsman Reform written by Richard Kirkham and published by Palgrave Pivot. This book was released on 2020-05-07 with total page 154 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book seeks to persuade policy-makers and legislators of the need for legislative reform of the ombudsman sector, and to evidence the ways in which such reformative legislation can be designed. In pursuing this goal, this edited collection represents an academic response to a challenge laid down by the current Parliamentary Ombudsman in February 2018, at a JUSTICE event. It draws on the original research of the authors and bases its proposals for reform on a fundamental re-assessment of the focus and purpose of ombudsman systems. A Manifesto for Ombudsman Reform deals with key, recurring controversies in ombudsman scholarship, including the role that the ombudsman should be fulfilling, the procedures it should employ, the powers that are necessary for effectiveness, and the means of ensuring both freedom of operation and accountability. It will inform academic and policy debates about the future of the ombudsman institution in the UK and its analysis should be of interest to academics and policy-makers in other jurisdictions.
Book Synopsis Conflict of Interest in Policing by : Cindy Davids
Download or read book Conflict of Interest in Policing written by Cindy Davids and published by Institute of Criminology. This book was released on 2008 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Conflict of interest allegations have become a prominent part of the landscape of political and public sector ethics in Australia and overseas. The arena of policing has not been immune from this problem and this book is based on unique and unfettered access to ten years of internal investigation files held by Victoria Police. Through detailed analysis of actual complaint cases it gives the reader a comprehensive map by which to chart the particular kinds of interests involved, the nature of conflicts with official police duties, and the particular contexts from which conflicts of interest emerge. The book examines conflicts of interest across the private and public realm of the everyday lives of police officers. The author outlines how the problem of conflict of interest is an important aspect of police ethics, arguing that recognition of, and accountability for, conflict of interest may be a significant element in preventing upstream police misconduct and corruption. Conflict of Interest in Policing seeks to provide a conceptual and practical understanding of how integrity and trust must be integrated into the profession of policing through processes of active responsibility, rather than more traditional passive obedience to prescriptive rules.

Book Synopsis Public Services Ombudsman by : Great Britain: Law Commission
Download or read book Public Services Ombudsman written by Great Britain: Law Commission and published by The Stationery Office. This book was released on 2010-09-02 with total page 106 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report presents proposals by the Law Commission for reforms to make it easier to complain if you suffer poor public services. The public services ombudsmen have wide-ranging powers to investigate complaints against health service providers, housing associations and a host of Government departments and agencies. Complaints are dealt with for free and can result in financial compensation and an apology. But the procedures for making a complaint are often outdated and inconsistent. For example, complaints must usually be submitted in writing and in some cases can be made only through an MP. The proposed reforms will help to keep cases out of court: under current rules the ombudsman should not deal with a complaint after court proceedings have begun, even if the complainant was badly advised to go to court. In future, the Law Commission would like courts to transfer appropriate cases to the ombudsman. The consultation focuses on five statutory ombudsmen: the Parliamentary Commissioner for Administration, Public Services Ombudsman for Wales, and the Local Government, Health Service and Housing Ombudsmen

Book Synopsis Time for a People's Ombudsman Service - HC 655 by : Great Britain: Parliament: House of Commons: Public Administration Select Committee
Download or read book Time for a People's Ombudsman Service - HC 655 written by Great Britain: Parliament: House of Commons: Public Administration Select Committee and published by The Stationery Office. This book was released on 2014-04-28 with total page 64 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this report the Public Administration Select Committee (PASC) calls for a 'People's Ombudsman' and says the Parliamentary and Health Service Ombudsman (PHSO), which investigates complaints against the NHS and other government departments and agencies, is outdated. Citizens should have direct and more user-friendly access to the Ombudsman. None of the Ombudsmen created since the PHSO's operations were established in legislation 47 years ago have adopted the same restricted model as the Parliamentary Ombudsman. As a priority, the restriction on citizens' direct and open access to PHSO, known as the MP filter, must be abolished (as is already the case in respect of NHS complaints). PHSO must be able to receive complaints other than in writing: such as in person, by telephone or online, just as is expected of any normal complaints system. PHSO should have powers to investigate areas of concern without having first to receive a complaint from a service user. Parliament should strengthen the accountability of PHSO. PASC, along with other Departmental Select Committees, should make greater use of the intelligence gathered by the PHSO to hold Government to account. A consultation should be held on the creation of a single public services ombudsman for England. At the same time, there must be a distinctive ombudsman service for UK non-devolved matters.

Book Synopsis Ombudsmen and ADR by : Naomi Creutzfeldt
Download or read book Ombudsmen and ADR written by Naomi Creutzfeldt and published by Springer. This book was released on 2018-05-02 with total page 199 pages. Available in PDF, EPUB and Kindle. Book excerpt: How do ordinary people experience and make sense of the informal justice system? Drawing on original data with British and German users of Ombudsmen— an important institution of informal justice, Naomi Creutzfeldt offers a nuanced comparative answer to this question. In so doing, she takes current debates on procedural justice and legal consciousness forward. This book explores consciousness around ‘alternatives’ to formal legality and asks how situated assumptions about law and fairness guide people's understandings of the informal justice system. Creutzfeldt shows that the everyday relationship that people have with the informal justice system is shaped by their experiences and expectations of the formal legal system and its agents. This book is an innovative theoretical and empirical statement about the future prospects for informal justice in Europe.
