Book excerpt: Oklahoma Legal Research is the first book focused exclusively on how to research Oklahoma law. Oklahoma Legal Research examines resources and research methods for all types of Oklahoma primary law, secondary law, and practice materials; with chapters on researching Oklahoma statutory, regulatory, and case law. The book also includes a chapter on researching tribal law for Native American tribes located in Oklahoma; discusses how to do historical statutory research to locate the increasingly available legislative history materials for Oklahoma statutes; and covers resources and methods in both print and online formats, with visuals included to assist the researcher. This text has been written for legal researchers of various levels of experience and training. For those just learning the intricacies of legal research, it explains the basic processes and introduces the novice to the most important sources of Oklahoma and Native American tribal law. It also briefly discusses analogous materials in federal law, so that the less experienced researcher can better see the parallels between state and federal research.Experienced researchers will also benefit from having a text that brings together both print and online sources of Oklahoma law and that will assist them in determining which of those sources are better suited to accomplishing a particular research task. This book is part of the Legal Research Series, edited by Suzanne E. Rowe, Director of Legal Research and Writing, University of Oregon School of Law.

When should virtual world activities or augmented reality images count as protected First Amendment ‘speech’, and when are they instead a nuisance or trespass? When does copying them infringe intellectual property laws? When should a person (or computer) face legal consequences for allegedly harmful virtual acts? The Research Handbook on the Law of Virtual and Augmented Reality addresses these questions and others, drawing upon free speech doctrine, criminal law, issues of data protection and privacy, legal rights for increasingly intelligent avatars, and issues of jurisdiction within virtual and augmented reality worlds.

Book excerpt: The critical analyses presented in the Fifth Edition of Murray on Contracts provide students with the insights necessary to gain a comprehensive understanding of the law of contracts. This text also considers and critically analyzes statutory modifications of neoclassical contract doctrine beyond the UCC. Many of the sections contain captioned subdivisions so that the reader is more easily directed to topical discussions within the sections. The author includes citation tables to Restatement and UCC sections as well as a table of cases, along with an expansive index. In addition, the appendix includes the text of the United Nations convention on Contracts for the International Sale of Goods (CISG), and the final chapter provides an introduction to the CISG and compares its key provisions with the UCC and other principles of American contract law. This book also is available in a three-hole punched, alternative loose-leaf version printed on 8.5 x 11 inch paper with wider margins and with the same pagination as the hardbound book.

Breaking the oceanic divide, this book is the first legal research guide to consider internationalization and globalization in both the new law school curriculums and the changing practice of law. The book is a significant expansion and revision of the second edition of Legal Research Methods in the US and Europe. With the inclusion of material on China, Russia, and England - and on researching foreign law in general - the book now reflects a broader scope. Regarding US legal research, this edition explains the impacts and effects of major changes and developments that have occurred very recently, including the introduction of Bloomberg Law, WestlawNext, and the revolutionary Law.gov movement.

Available in PDF, EPUB and Kindle. Book excerpt: ""The best constitution in the United States today." That is how William Jennings Bryan described the proposed constitution for Oklahoma in 1907. Bryan was clearly engaging in hyperbole, but he was signifying that the drafters of Oklahoma's constitution were guided in the main by many of the concerns which were highlighted during what historians came to dub the Progressive Era.Although the Progressive mentality did not win every victory (Oklahoma's constitution did not then and does not now include a provision for the recall), Progressives were, in general, pleased with the document. In particular, they praised the provision for the initiative and the referendum. Perhaps they did not anticipate that the initiative provision would, by the end of the 1900s, be used over 140 times to amend the very document they had drafted. One reason for the numerous amendments is the fact that so many details were included in the original document (about 50,000 words in length when finished in 1907). Many of these details would quickly become outdated or obsolete, and thus in need of amending. This attention to detail was not just a product of numerous interests seeking to have their favorite provision included in the constitution, but a fear of the drafters that they would not be able to trust the state legislature created by the new constitution to take the interests of the mass of Oklahoma citizens into account when enacting laws. An enduring characteristic of Oklahoma's constitution, however, has been its faith in direct democracy. In 2018 alone, Oklahomans had the opportunity to vote on six provisions to modify state laws or the state's constitution. These included issues that ranged from a state law legalizing medical marijuana (which passed) to amending the state's constitution to allow optometrists to operate in Wal-Mart stores (which did not pass). This volume traces the historical formation and constitutional development of the state. This development, given the frequency with which Oklahomans deem it necessary to change, is literally an ongoing process"--

Book excerpt: With stories from the front lines, a legal scholar journeys through distinct legal climates to understand precisely why and how the war over abortion is being fought. Drawing on her years of research in El Salvador—one of the few countries to ban abortion without exception—legal scholar Michelle Oberman explores what happens when abortion is a crime. Oberman reveals the practical challenges raised by a thriving black market in abortion drugs, as well as the legal challenges to law enforcement. She describes a system in which doctors and lawyers collaborate in order to identify and prosecute those suspected of abortion-related crimes, and the troubling results of such collaboration: mistaken diagnoses, selective enforcement, and wrongful convictions. Equipped with this understanding, Oberman turns her attention to the United States, where the battle over abortion is fought almost exclusively in legislatures and courtrooms. Beginning in Oklahoma, one of the most pro-life states, and through interviews with current and former legislators and activists, she shows how Americans voice their moral opposition to abortion by supporting laws that would restrict it. In this America, the law is more a symbol than a plan. Oberman challenges this vision of the law by considering the practical impact of legislation and policies governing both motherhood and abortion. Using stories gathered from crisis pregnancy centers and abortion clinics, she unmasks the ways in which the law already shapes women’s responses to unplanned pregnancy, generating incentives or penalties, nudging pregnant women in one direction or another. In an era in which every election cycle features a pitched battle over abortion’s legality, Oberman uses her research to expose the limited ways in which making abortion a crime matters. Her insight into the practical consequences that will ensue if states are permitted to criminalize abortion calls attention to the naïve and misguided nature of contemporary struggles over abortion’s legality. A fresh look at the battle over abortion law, Her Body, Our Laws is an invitation to those on all sides of the issue to move beyond the incomplete discourse about legality by understanding how the law actually matters.
