Available in PDF, EPUB and Kindle. Book excerpt: For the last 30 years, National Security Law has helped create and shape an entire new field of law. It has been adopted for classroom use at most American law schools, all of the military academies, and many non-law graduate programs. The Seventh Edition of this leading casebook provides an up-to-date, user-friendly survey of this extremely dynamic field. Relying heavily on original materials and provocative notes and questions, this book encourages students to play the roles of national security professionals, politicians, judges, and ordinary citizens. And by showing the development of doctrine in historical context, it urges them to see their responsibility as lawyers to help keep us safe and free. Like earlier editions, the new book deals with basic separation-of-powers principles, the interaction of U.S. and international law, the use of military force, intelligence, detention, criminal prosecution, homeland security, and national security information — more than enough to provide teachers with a rich menu of readings for classes. New to the Seventh Edition: Latest developments on U.S. military involvement in Syria and Iran President Trump’s Border Wall and appropriations power Carpenter v. U.S. and recent FISA developments and FISC decisions Trump travel ban “Defending forward” in cyberspace New chapter on nuclear war Professors and students will benefit from: Carefully curated and edited original materials Extensive notes and questions to fill in the blanks Read-ins and chapter summaries to provide perspective Frequent references to historical and political context

This book was released on 2019-06-17 with total page 922 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'This book makes uncomfortable reading both in its detailed analysis of terrorism and its causes, and in the critique of state responses, particularly in modern times. It is unusual to have such a defence of a 'human rights framework' from a counter-terrorism practitioner rather than from within the legal fraternity. It is this that makes the case even more persuasive. All who are involved in counter-terrorism strategy should consider carefully the arguments put forward.'Global Policy JournalFor more than 150 years, nationalist, populist, Marxist and religious terrorists have all been remarkably consistent and explicit about their aims: provoke states into over-reacting to the threat they pose, then take advantage of the divisions in society that result. Yet, state after state falls into the trap that terrorists have set for them. Faced with a major terrorist threat, governments seem to reach instinctively for the most coercive tools at their disposal and, in doing so, risk exacerbating the situation. This policy response seems to be driven in equal parts by a lack of understanding in the true nature of the threat, an exaggerated faith in the use of force, and a lack of faith that democratic values are sufficiently flexible to allow for an effective counter-terrorism response. Drawing on a wealth of data from both historical and contemporary sources, Avoiding the Terrorist Trap addresses common misconceptions underpinning flawed counter-terrorist policies, identifies the core strategies that guide terrorist operations, consolidates the latest research on the underlying drivers of terrorist violence, and then demonstrates why a counter-terrorism strategy grounded in respect for human rights and the rule of law is the most effective approach to defeating terrorism.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Book excerpt: Scores of talented and dedicated people serve the forensic science community, performing vitally important work. However, they are often constrained by lack of adequate resources, sound policies, and national support. It is clear that change and advancements, both systematic and scientific, are needed in a number of forensic science disciplines to ensure the reliability of work, establish enforceable standards, and promote best practices with consistent application. Strengthening Forensic Science in the United States: A Path Forward provides a detailed plan for addressing these needs and suggests the creation of a new government entity, the National Institute of Forensic Science, to establish and enforce standards within the forensic science community. The benefits of improving and regulating the forensic science disciplines are clear: assisting law enforcement officials, enhancing homeland security, and reducing the risk of wrongful conviction and exoneration. Strengthening Forensic Science in the United States gives a full account of what is needed to advance the forensic science disciplines, including upgrading of systems and organizational structures, better training, widespread adoption of uniform and enforceable best practices, and mandatory certification and accreditation programs. While this book provides an essential call-to-action for congress and policy makers, it also serves as a vital tool for law enforcement agencies, criminal prosecutors and attorneys, and forensic science educators.

Available in PDF, EPUB and Kindle. Book excerpt: "Nuclear terrorism is such a disturbing prospect that we shy away from its details. Yet as a consequence, we fail to understand how best to defeat it. Michael Levi takes us inside nuclear terrorism and behind the decisions a terrorist leader would be faced with in pursuing a nuclear plot. Along the way, Levi identifies the many obstacles, large and small, that such a terrorist scheme might encounter, allowing him to discover a host of ways that any plan might be foiled. Surveying the broad universe of plots and defenses, this accessible account shows how a wide-ranging defense that integrates the tools of weapon and materials security, law enforcement, intelligence, border controls, diplomacy, and the military can multiply, intensify, and compound the possibility that nuclear terrorists will fail. Levi draws from our long experience with terrorism and cautions us not to focus solely on the most harrowing yet most improbable threats. Nuclear terrorism shares much in common with other terrorist threats--and as a result, he argues, defeating it is impossible unless we put our entire counterterrorism and homeland security house in order. As long as we live in a nuclear age, no defense can completely eliminate nuclear terrorism. But this book reminds us that the right strategy can minimize the risks and shows us how to do it."
