In these "games" the rules can only persist if people can be expected to be moved by considerations of fidelity and fairness, not only of prudence. This book takes a fresh look at the perennial problems of legal philosophy - the source of obligation to obey the law, the nature of authority, the relationship between law and morality, and the nature of legal argument - from the perspective of this conventionalist understanding of social rules. It argues that, since the resilience of such rules depends on cooperative dispositions, conventionalism, properly understood, does not imply positivism.

Book excerpt: The workplace is the ideal environment for tying together management theory and practice and yet, classes in many regular management development programs are conducted away from the work site, and class sizes are so large that individual instruction is difficult to achieve. In this book, the authors seek effective ways to merge theory with workplace practice, and advocate the modular preceptor method whereby participants work together in dyads and triads with a preceptor acting as advisor and instructor. Unlike traditional management development programs which do not usually lead to behavior changes, the modular preceptor model has behavior change as the basic aim. Participants can remain at work while experiencing individualized learning, developing problem solving skills, and acquiring new knowledge which can be immediately applied to work situations. Various ways of learning, such as passive (lecture, case study, discussion) and experiential (role playing, games, sensitivity training) are examined. No single mode of learning can be comprehensive and adequate for all situations. The authors contend, however, that experiential learning is most effective for increasing the will and competence to learn and for using what is learned to change manager behavior. The purpose of the modular preceptor approach is not to present answers to specific managerial or organizational problems, but to help the participant acquire new problem definition and problem solving skills, and the confidence to apply them on the job. This book also analyzes the contribution of the behavioral sciences to the philosophies and techniques behind management instruction, and examines the role of the university in management development and the future direction of MBA programs. For anyone concerned with meaningful and effective management development, this book is an invaluable resource.

Book excerpt: Sanford C. Goldberg presents a novel account of the speech act of assertion. He defends the view that this type of speech act is answerable to a constitutive norm—the norm of assertion. The hypothesis that assertion is answerable to a robustly epistemic norm is uniquely suited to explain assertion's philosophical significance—its connections to other philosophically interesting topics. These include topics in epistemology (testimony and testimonial knowledge; epistemic authority; disagreement), the philosophy of mind (belief; the theory of mental content), the philosophy of language (norms of language; the method of interpretation; the theory of linguistic content), ethics (the ethics of belief; what we owe to each other as information-seeking creatures), and other matters which transcend any subcategory (anonymity; trust; the division of epistemic labor; Moorean paradoxicality). Goldberg aims to bring out these connections without assuming anything about the precise content of assertion's norm, beyond regarding it as robustly epistemic. In the last section of the book, however, he proposes that we do best to see the norm's epistemic standard as set in a context-sensitive fashion. After motivating this proposal by appeal to Grice's Cooperative Principle and spelling it out in terms of what is mutually believed in the speech context, Goldberg concludes by noting how this sort of context-sensitivity can be made to square with assertion's philosophical significance.

At the end of the 1980s the collapse of the Soviet-type socialist economic system had become clear and, hence, the necessity to transform these systems into an entirely different eco nomic order. Similar processes have happened and still happen in other his torical constellations, for instance in developing countries. It has been the aim of the Transformation Colloquium to gain more theoretical insight into these phenomena. The object of research has been transformation defined as transition from a given economic order (socialist planned economy e.g.) to a consistent new or der (market economy). This is a highly complex phenomenon which occurred, above all, during the 20th century: introduction and abolition of socialist sys tems, transition from war economies to peace-time market economies. Histori cal experience allows perhaps for certain generalizing abstractions. The central problem discussed at all (up to now) three colloquia is the question whether the object is amenable for theoretical analysis and which approaches eventually are promising.
