Available in PDF, EPUB and Kindle. Book excerpt: This practical guide shows how to build an effective compliance and ethics program that will lower a business's risks and improve productivity. Research increasingly supports the notion that ethical, compliant businesses see increased productivity across a range of measurements. This practical guide tells business professionals, business and law students, and other interested parties exactly how that goal can be achieved. The book covers an extensive range of ethics-compliant laws and regulations impacting businesses today and identifies critical factors for successful compliance programs. Going well beyond works that speak in general terms about compliance-based actions, this unique volume delves into details about specific regulatory issues and the steps that can be taken to mitigate risk. The first half of the book shares general guidelines for creating or improving internal compliance and ethics programs. The second half identifies specific, high-risk regulatory areas; provides an overview of relevant laws; and sets forth best practices specific to the regulations discussed. By providing a simplified understanding of compliance with laws related to issues such as antitrust, international business, wages and labor, Health Insurance Portability and Accountability Act (HIPAA) and health care, the environment and more, the guide offers readers the tools necessary to improve an existing compliance program or create a new program where none has existed before.

Available in PDF, EPUB and Kindle. Book excerpt: A Better Kind of Compliance Training Compliance training succeeds when you balance an organization’s legal responsibilities with the real needs of the employees who you hope will learn and change their behavior. In Fully Compliant, Travis Waugh challenges traditional compliance training that focuses only on the legal risk of failing to comply with a specific mandate. With an ever-increasing number of compliance subjects to address, such programs are unsustainable. Instead, organizations must design compliance programs that serve a higher, broader purpose and build robust, resilient cultures focusing on integrity and ethics learning. Optimal compliance programs are flexible and create real learning experiences that change real behavior, thus diminishing the chance of misconduct in the first place. This book connects the three levers of human behavior—context, habit, and motivation— to help organizations craft holistic compliance training programs that do far more than check a box. It identifies ways to pick up small but meaningful wins in turning around an existing compliance program or designing a new course, which can turn stakeholders from skeptics into learning champions. And it offers an eight-step road map for implementing your own compliance learning plan. With this book, you’ll be able to: Create behavior-based compliance training that generates measurable benefits. Make compliance training more engaging and impactful, not one-size-fits-all. Remain relevant as advances in technology shift compliance expectations in the years ahead. By putting the learner first, you can develop compliance that stick

Available in PDF, EPUB and Kindle. Book excerpt: The Architecture of Neoliberalism pursues an uncompromising critique of the neoliberal turn in contemporary architecture. This book reveals how a self-styled parametric and post-critical architecture serves mechanisms of control and compliance while promoting itself, at the same time, as progressive. Spencer's incisive analysis of the architecture and writings of figures such as Zaha Hadid, Patrik Schumacher, Rem Koolhaas, and Greg Lynn shows them to be in thrall to the same notions of liberty as are propounded in neoliberal thought. Analysing architectural projects in the fields of education, consumption and labour, The Architecture of Neoliberalism examines the part played by contemporary architecture in refashioning human subjects into the compliant figures - student-entrepreneurs, citizen-consumers and team-workers - requisite to the universal implementation of a form of existence devoted to market imperatives.

Available in PDF, EPUB and Kindle. Book excerpt: Nearly everyone accepts as gospel two assumptions: compliance with environmental rules is high, and enforcement is responsible for making compliance happen. Both are wrong. In fact, serious violations of environmental regulations are widespread, and by far the most important driver of compliance results is not enforcement but the structure of the rule itself. In Next Generation Compliance, Cynthia Giles shows that well-designed regulations deploying creative strategies to make compliance the default can achieve excellent implementation outcomes. Poorly designed rules that create many opportunities to evade, obfuscate, or ignore will have dismal performance that no amount of enforcement will ever fix. Rampant violations have real consequences: unhealthy air, polluted water, contaminated drinking water, exposure to dangerous chemicals, and unrestrained climate-forcing pollution. They also land hardest on already overburdened communities - that's why Next Gen and environmental justice are tightly linked. The good news is there are tools to build much better compliance into regulations, including many tested strategies that can be the building blocks of programs that withstand the inevitable pressures of real life. Next Generation Compliance shows how regulators can avoid the compliance calamities that plague far too many environmental rules today, a lesson that is particularly urgent for regulations tackling climate change. It has an optimistic message: there are ways to ensure reliable results, if regulators jettison incorrect assumptions and design rules that are resilient to the mess and complexity of the real world.

Available in PDF, EPUB and Kindle. Book excerpt: Few global security issues stimulate more fervent passion than the application of brute force. Despite the fierce debate raging about it in government, society and the Academy, inadequate strategic understanding surrounds the issue, prompting the urgent need for —the first comprehensive systematic global analysis of 21st century state-initiated internal and external applications of brute force. Based on extensive case evidence, Robert Mandel assesses the short-term and long-term, the local and global, the military, political, economic, and social, and the state and human security impacts of brute force. He explicitly isolates the conditions under which brute force works best and worst by highlighting force initiator and force target attributes linked to brute force success and common but low-impact force legitimacy concerns. Mandel comes to two major overarching conclusions. First, that the modern global application of brute force shows a pattern of futility—but one that is more a function of states' misapplication of brute force than of the inherent deficiencies of this instrument itself. Second, that the realm for successful application of state-initiated brute force is shrinking: for while state-initiated brute force can serve as a transitional short-run local military solution, he says, it cannot by itself provide a long-run global strategic solution or serve as a cure for human security problems. Taking the evidence and his conclusions together, Mandel provides policy advice for managing brute force use in the modern world.
