Download or read book Imprisonment Today and Tomorrow written by D. van Zijl-Smit and published by BRILL. This book was released on 2021-11-22 with total page 891 pages. Available in PDF, EPUB and Kindle. Book excerpt: Are more people being imprisoned throughout the world? Why is imprisonment still being used on a wide scale when an increasing number of alternatives are available? What are the major developments in prison law in the last decade? What problems arise in prison systems when states become constitutional democracies for the first time? Should prisons be privatized? How can prison conditions and prisoners' rights be improved? What special measures should there be for women, juveniles, violent offenders or drug addicts in prison? What programmes work effectively under which conditions? The second edition of "Imprisonment Today and Tomorrow" presents much fresh information in its attempts to provide answers to these and other crucial questions. It provides authoritative accounts by leading national experts on the place of imprisonment in 26 penal systems of major countries throughout the world. In addition, through the chapters on the work of the European Committee for the Prevention of Torture and Inhuman and Degrading Punishment, non-governmental organizations and the United Nations, it sheds new light on international initiatives to promote prison standards. These are complemented by a comparative survey of world prison populations and a final chapter in which the editors evaluate developments described in this volume and elsewhere in order to arrive at conclusions about international trends and to make well-grounded proposals for prison reform.

Book Synopsis Bringing International Fugitives to Justice by : David A. Sadoff
Download or read book Bringing International Fugitives to Justice written by David A. Sadoff and published by Cambridge University Press. This book was released on 2016-12-24 with total page 725 pages. Available in PDF, EPUB and Kindle. Book excerpt: A novel and robust framework for the operational and legal analysis of recovering fugitives abroad, Bringing International Fugitives to Justice addresses how states, working alone, in cooperation, or with third-party intervention, strive to secure the custody of fugitives in order to bring them to justice - for prosecution or punishment purposes - while evaluating the lawfulness of those pursuit efforts. The book introduces redefined terms and new concepts to add precision to the discourse; sets forth comprehensive typologies, including of extradition arrangements and impediments; and provides a mapping to account for the full range of means and methods - extradition, collateral and remedial approaches to extradition, and full-scale and fallback alternatives to extradition -by which international fugitives can be retrieved. The study considers the judicial, diplomatic, and policy consequences of reliance on the more aggressive or controversial alternatives, proffering recommendations that, if adopted, could facilitate the recovery of fugitives while minimizing associated risks.
Book Synopsis Towards the Development of the International Penal System by : Róisín Mulgrew
Download or read book Towards the Development of the International Penal System written by Róisín Mulgrew and published by Cambridge University Press. This book was released on 2013-07-11 with total page 435 pages. Available in PDF, EPUB and Kindle. Book excerpt: Based on extensive empirical research, this groundbreaking book describes and analyses existing systems for enforcing sentences of imprisonment imposed by international criminal courts and makes recommendations for the strategic and structural development of the international penal system. In particular, it advocates a resocialisation-focused international penal policy delivered using restorative justice modalities post-conviction and the creation of an accountable international prison system. Singly or combined, these developments will contribute to the institutionalisation of the international penal system and enhance the international nature of the sanction, the international control over the way international punishment is enforced and the equal treatment of international prisoners. These developments will also help to ensure that international punishment is principled and progressive and implemented in a humane and effective system.

Download or read book Prisoners of the International Community written by Denis Abels and published by Springer Science & Business Media. This book was released on 2012-09-14 with total page 857 pages. Available in PDF, EPUB and Kindle. Book excerpt: Little has been written about the legal position and conditions of detention of persons detained by international criminal tribunals, particularly as regards their internal legal position (their rights and duties inside the remand facility). The primary purpose of this book is to set out the law governing the detention of persons detained under the tribunals’ jurisdiction. The book provides a detailed account of this area of international criminal law. It sets out the applicable law, including the law’s underlying principles, and focuses on a number of specific procedural and substantive legal issues. As to procedural issues, it examines the available complaints and disciplinary procedures as well as procedures applicable to the designation of States for the enforcement of the tribunals’ sentences. In respect of substantive law, it examines the detainees’ right to contact with the outside world, including contact with their relatives, with their lawyers and with the media. The book will be an extremely useful guidance for practitioners in applying the law and principles of the tribunals’ detention law, particularly because it is the first monograph written on the topic.
