Dopo una ricognizione della legislazione, nazionale ed unionale, l’opera si divide essenzialmente in due parti: nella prima viene esaminata la natura giuridica delle misure di prevenzione sia personali che patrimoniali, dando conto della giurisprudenza della Corte Edu espressasi sul tema, nella seconda si affrontano i profili processuali e la questione inerente la pubblicità dell’udienza camerale nel procedimento di prevenzione patrimoniale, pure affrontata dalla Corte di Strasburgo. Sotto il primo profilo, la trattazione mette anzitutto in luce il collegamento funzionale che sussiste tra la prevenzione personale e quella patrimoniale, sottolineando come la pericolosità sociale, presupposto per l’applicazione delle misure di prevenzione personali, sia a fondamento inoltre della misura patrimoniale, anche a seguito delle riforme che, tra il 2008 ed il 2009, hanno affermato il principio di applicazione disgiunta delle misure di prevenzione. Sotto il secondo aspetto, si descrive l’iter del procedimento di prevenzione patrimoniale, illustrando la giurisprudenza del giudice convenzionale che lo ha stigmatizzato sotto il profilo dell’equo processo, e tenendo conto delle innovazioni apportate dal legislatore con legge n. 161/2017, che ha introdotto il principio della trattazione prioritaria dei procedimenti di prevenzione. L’opera si conclude, evidenziando come, nonostante il continuo processo di sviluppo normativo, le misure di prevenzione patrimoniali presentino ancora notevoli criticità, soprattutto con riferimento ai compendi aziendali in relazione ai quali si parla oggi di nuove forme di prevenzione “risanante”, secondo una visione integrata del diritto penale.
