Book excerpt: This monograph examines from several national and comparative standpoints the framework within which military organizations can contribute to the well-being of civilian society when in need of support during normal times or periods of crisis in a domestic or international setting. It is therefore concerned, inter alia, with the risks and challenges posed by organized crime, unlawful drugs, terrorism, illegal or mass migration, and peacetime contingencies that will continually require updated and more sophisticated forms of supportive interaction between the civil and the military authorities.

Book excerpt: Abstract: Peace operations became the core focus of many Western armed forces after the Cold War. The wish amongst political and military leaders during the 1990s to hold on to the classical identity of the armed forces as an instrument of force made them pursue a strict separation between military operations and the civilian aspects of peacekeeping, such as policing, administrative functions, and political and societal reconstruction. In his book Soldiers and Civil Power, Thijs Brocades Zaalberg argues that this policy failed to match up to reality. Supporting civil authorities, and at times even substituting them (de facto military governance), became the key to reaching any level of success in Cambodia, Somalia, Bosnia and Kosovo. As a result of the false segregation between the civilian and the military domain, this was accomplished mostly by improvisation and creativity of commanders who probed for the limiting boundaries of their original mandate by reaching ever further into the civil

Book excerpt: In countries such as Syria, Iraq, South Sudan, and Yemen, internationally recognized governments embroiled in protracted armed conflicts, and with very little control over their territory, have requested direct military assistance from other states. These requests are often accepted by the other states, despite the circumvention of the United Nations Security Council and extensive violation of international humanitarian law and human rights. In this book, Erika De Wet examines the authority entitled to extend a request for (or consent to) direct military assistance, as well as the type of situations during which such assistance may be requested, notably whether it may be requested during a civil war. Ultimately, De Wet addresses the question of if and to what extent the proliferation of military assistance on the request of a recognized government is changing the rules in international law applying to the use of force.

Available in PDF, EPUB and Kindle. Book excerpt: Since the Cold War, peace operations have become the core focus of many Western armed forces. In these operations, the division between civil and military responsibilities often rapidly blurs. Among policy makers and in military circles, a debate has erupted regarding the scope of the military in stabilizing and reconstructing war torn societies. Should soldiers, who primarily prepare for combat duties, observe a strict segregation between the "military sphere" and the "civilian sphere" or become involved in "nation building"? Should soldiers be allowed to venture into the murky arena of public security, civil administration, humanitarian relief, and political and social reconstruction? In Soldiers and Civil Power, Thijs Brocades Zaalberg draws on military records and in-depth interviews with key players to examine international operations in the 1990's in Cambodia, Somalia, Bosnia, and Kosovo. Focusing his historical analysis on the experiences of various battalions in the field, he reveals large gaps between this tactical level of operations, political-strategic decision making and military doctrine. By comparing peace operations to examples of counterinsurgency operations in the colonial era and military governance in World War II, he exposes the controversial, but inescapable role of the Western military in supporting and even substituting civil authorities during military interventions. At a time when US forces and its allies struggle to restore order in Iraq and Afghanistan, Brocades Zaalberg’s in-depth study is an invaluable resource not only for military historians, but anyone interested in the evolving global mission of armed forces in the twenty-first century.

Available in PDF, EPUB and Kindle. Book excerpt: Army Doctrine Publication (ADP) 3-28 describes a doctrinal foundation for the Army's contribution to defense support of civil authorities (also called DSCA) (see figure 1, page iv, for a graphical overview). ADP 3-28 focuses on the operational Army battalions, brigades, division headquarters, and Army Service component headquarters conducting DSCA, with support from the generating force. A corresponding Army doctrine reference publication (ADRP) elaborating on the principles in ADP 3-28 is expected to replace Field Manual (FM) 3-28. The principal audience for ADP 3-28 is all members of the profession of arms. Commanders and staffs of Army headquarters serving as joint task force or multinational headquarters should also refer to applicable joint or multinational doctrine concerning the range of military operations and joint or multinational forces. Trainers and educators throughout the Army will also use this publication. Commanders, staffs, and subordinates ensure their decisions and actions comply with applicable United States, international, and, in some cases, host-nation laws and regulations. Commanders at all levels ensure their Soldiers operate in accordance with the law of war and the rules of engagement. (See Field Manual [FM] 27-10.) ADP 3-28 applies to the Active Army, Army National Guard/Army National Guard of the United States, and United States Army Reserve unless otherwise stated. ADP 3-28 does not apply to certain Army organizations and activities that support civil authorities or emergency response. First, state Army National Guard support in state active duty status falls outside the definition of DSCA. Second, ADP 3-28 does not address domestic counterterrorism operations. Third, it does not apply to any state defense force or equivalent that is not part of a state's National Guard. Fourth, ADP 3-28 does not apply to military activities conducted wholly within any military installation in the United States. Finally, it does not apply to the United States Army Corps of Engineers (USACE) although USACE plays a significant role in DSCA. United States Pacific Command (USPACOM) and United States Northern Command (USNORTHCOM) conduct DSCA within their respective combatant commands. This ADP uses terminology and methods universal to DSCA. Users in USPACOM should refer to theater plans and procedures for DSCA.

Available in PDF, EPUB and Kindle. Book excerpt: Anytime the use of US Armed Forces in support of civil authorities is considered, government and military leaders, pundits, and citizens reflexively turn to the Posse Comitatus Act for guidance. Since 9/11, the US Armed Forces face an increased likelihood that they will be called on to participate in actions typically viewed as civil matters. Many have also called for an increased role for the US Armed Forces in responding to natural disasters. Though many constitutional provisions, laws, and legal rulings govern this question, in the minds of many, the Posse Comitatus Act has prominence. Most individuals think they know what the Posse Comitatus Act allows and disallows; most of them are wrong.
