Book excerpt: Mechanical and Digital Phonorecord Delivery Compulsory Licenses (US U.S. Copyright Office Regulation) (COLC) (2018 Edition) The Law Library presents the complete text of the Mechanical and Digital Phonorecord Delivery Compulsory Licenses (US U.S. Copyright Office Regulation) (COLC) (2018 Edition). Updated as of May 29, 2018 The United States Copyright Office is issuing a final rule to implement section 115 of the Copyright Act of 1976. Section 115 establishes a compulsory license for the making and distribution of phonorecords of nondramatic musical works. Section 115, in turn, requires the Register of Copyrights to prescribe by regulation the procedures for the monthly payment of royalties and preparation and service of monthly and annual statements of account by licensees. This final rule updates the existing payment and statement-of-account regulations in response to legal and marketplace developments, including the Copyright Royalty Board's adoption of newer percentage-of-revenue royalty rate structures for certain digital music services, and changes in accounting and industry practice in the years since the rules were last substantially amended. Updated as of May 29, 2018 The Copyright Royalty Board, acting pursuant to statute, referred a novel question of law to the Register of Copyrights concerning the designation of certain digital subscription music services as preexisting subscription services. Specifically, the Copyright Royalty Board requested a decision by the Register of Copyrights regarding whether the universe of preexisting subscription services was limited to three specific services. The Register of Copyrights, in a timely fashion, transmitted a Memorandum Opinion to the Copyright Royalty Board confirming that only three music services qualify as a preexisting subscription service for purposes of performing a sound recording publicly by means of a subscription digital audio transmission pursuant to a statutory license. Book excerpt: Home recording technologies allow today's consumer to make near-perfect copies of recorded music, television shows, movies, and other copyrighted works for private use at home. With the advance of digital recording equipment, consumers will be able to reproduce these copyrighted works with even greater accuracy. This is an issue of great concern for copyright owners, who claim that home copying is detrimental to their sales. This report presents an examination of home recording technologies and their relationship to the legal status of home copying, a comparison of the economic effects that home audiotaping may have on the recording industry with the effects that restricting home taping might have on consumers, a discussion of legal action that Congress or the industry may initiate, and the results of a national survey of home taping and copying behavior. The report is divided into seven chapters: (1) Summary, Issues, and Options; (2) Technological Change and Home Copying; (3) Legal Aspects of Copyright and Home Copying; (4) An Overview of the U.S. Record Industry; (5) Copyright Royalties for Music and Sound Recording; (6) The OTA (Office of Technology Assessment) Survey; and (7) Economic Perspectives on Home Copying. Appendixes contain a description of the survey development and review, a copy of the survey questionnaire, OTA survey tables, and a list of contractor reports related to the study. (MAB)

Book excerpt: Designation of Agent to Receive Notification of Claimed Infringement (US U.S. Copyright Office Regulation) (COLC) (2018 Edition) The Law Library presents the complete text of the Designation of Agent to Receive Notification of Claimed Infringement (US U.S. Copyright Office Regulation) (COLC) (2018 Edition). Updated as of May 29, 2018 Under the Digital Millennium Copyright Act ("DMCA"), the U.S. Copyright Office is required to maintain a "current directory" of agents that have been designated by online service providers to receive notifications of claimed infringement. Since the DMCA's enactment in 1998, online service providers have designated agents with the Copyright Office using the Office's or their own paper form, and the Office has made scanned copies these filings available to the public by posting them on the Office's Web site. Although the DMCA requires service providers to update their designations with the Office as information changes, an examination of the Office's current directory reveals that many have failed to do so, and that much of the information currently contained in the directory has become inaccurate and out of date. On September 28, 2011, the Office issued a notice of proposed rulemaking to update relevant regulations in anticipation of creating a new electronic system through which service providers would be able to more efficiently submit, and the public would be better able to search for, designated agent information. On May 25, 2016, with the electronic system in its final stages of development, the Office issued a notice of proposed rulemaking proposing significantly lower fees for designating agents through the forthcoming online system. As the next step in implementation, the Office today announces the adoption of a final rule to govern the designation and maintenance of DMCA agent information under the new electronic system and to establish the applicable fees. Book excerpt: Second in the Rifters Trilogy, Hugo Award-winning author Peter Watts' Maelstrom is a terrifying explosion of cyberpunk noir. This is the way the world ends: A nuclear strike on a deep sea vent. The target was an ancient microbe—voracious enough to drive the whole biosphere to extinction—and a handful of amphibious humans called rifters who'd inadvertently released it from three billion years of solitary confinement. The resulting tsunami killed millions. It's not as through there was a choice: saving the world excuses almost any degree of collateral damage. Unless, of course, you miss the target. Now North America's west coast lies in ruins. Millions of refugees rally around a mythical figure mysteriously risen from the deep sea. A world already wobbling towards collapse barely notices the spread of one more blight along its shores. And buried in the seething fast-forward jungle that use to be called Internet, something vast and inhuman reaches out to a woman with empty white eyes and machinery in her chest. A woman driven by rage, and incubating Armageddon. Her name is Lenie Clarke. She's a rifter. She's not nearly as dead as everyone thinks. And the whole damn world is collateral damage as far as she's concerned. . . . At the Publisher's request, this title is being sold without Digital Rights Management Software (DRM) applied.

Whilst it assumes a modest familiarity with computers, the book provides a guide to the issues suitable for undergraduates. In doing so, the author prompts students to consider questions such as: * How do morality and the law relate to each other? * What should be covered in a professional code of conduct for information technology professionals? * What are the ethical issues relating to copying software? * Is electronic monitoring o employees wrong? * What are the moral codes of cyberspace? Throughout, the book shows how in many ways the technological development is outpacing the ability of our legal systems, and how different paradigms applied to ethical questions often proffer conflicting conclusions. As a result, students will find this a thought-provoking and valuable survey of the new and difficult ethical questions posed by the Internet, artificial intelligence, and virtual reality.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers invaluable insights about the full spectrum of core design course contents systematically and in detail. This book is for instructors and students who are involved in teaching and learning of ‘capstone senior design projects’ in mechanical engineering. It consists of 17 chapters, over 300 illustrations with many real-world student project examples. The main project processes are grouped into three phases, i.e., project scoping and specification, conceptual design, and detail design, and each has dedicated two chapters of process description and report content prescription, respectively. The basic principles and engineering process flow are well applicable for professional development of mechanical design engineers. CAD/CAM/CAE technologies are commonly used within many project examples. Thematic chapters also cover student teamwork organization and evaluation, project management, design standards and regulations, and rubrics of course activity grading. Key criteria of successful course accreditation and graduation attributes are discussed in details. In summary, it is a handy textbook for the capstone design project course in mechanical engineering and an insightful teaching guidebook for engineering design instructors.
