Available in PDF, EPUB and Kindle. Book excerpt: “An original book…about individuals who used ideas to change the world” (The New Yorker)—the fascinating exploration into the creation and history of the Paris Peace Pact, an often overlooked but transformative treaty that laid the foundation for the international system we live under today. In 1928, the leaders of the world assembled in Paris to outlaw war. Within the year, the treaty signed that day, known as the Peace Pact, had been ratified by nearly every state in the world. War, for the first time in history, had become illegal. But within a decade of its signing, each state that had gathered in Paris to renounce war was at war. And in the century that followed, the Peace Pact was dismissed as an act of folly and an unmistakable failure. This book argues that the Peace Pact ushered in a sustained march toward peace that lasts to this day. A “thought-provoking and comprehensively researched book” (The Wall Street Journal), The Internationalists tells the story of the Peace Pact through a fascinating and diverse array of lawyers, politicians, and intellectuals. It reveals the centuries-long struggle of ideas over the role of war in a just world order. It details the brutal world of conflict the Peace Pact helped extinguish, and the subsequent era where tariffs and sanctions take the place of tanks and gunships. The Internationalists is “indispensable” (The Washington Post). Accessible and gripping, this book will change the way we view the history of the twentieth century—and how we must work together to protect the global order the internationalists fought to make possible. “A fascinating and challenging book, which raises gravely important issues for the present…Given the state of the world, The Internationalists has come along at the right moment” (The Financial Times).

Book excerpt: This unique two-volume work seeks for the first time to address in a comprehensive fashion both "substantive" and "procedural" aspects of international criminal law as applied by international and national courts. Substantive topics include individual criminal responsibility, genocide, war crimes, crimes against humanity, crimes against UN and associated personnel, core crimes and defenses, while procedural aspects include the right of suspects and accused, the protection of victims and witnesses, and pre-trial, trial and appeal procedures and practices. In addressing these subjects the work focuses on the practical application of the relevant norms and provides both detailed commentaries by experts in the field "(Commentary volume)," as well as the underlying documentation for each of the topics addressed "(Documents and Cases volume)," With the establishment of the International Criminal Court, the experiences of other international courts, notably the ad hoc tribunals for the former Yugoslavia and Rwanda as well as their predecessors, in addressing these issues are of great value and this work is intended to assist practitioners and scholars alike. Additionally, because national courts still have a vital role to play in the application of these norms, attention is given to prosecutions in national jurisdictions. With this work the editors seek both to assist the reader in understanding these important concepts as well as to provide the background documentation such that the reader can conduct his or her own research and come to his or her own conclusions.

Available in PDF, EPUB and Kindle. Book excerpt: Principles of International Criminal Law is one of the most influential textbooks in the field of international criminal justice. This fourth edition builds on the highly-successful work of the previous editions, setting out the general principles governing international crimes as well as the fundamentals of both substantive and procedural international criminal law. It provides a detailed understanding of the sources and evolution of international criminal law, demonstrating how it has developed, and how its application has changed. The book assesses in detail the four key international crimes as defined by the statute of the International Criminal Court: genocide, crimes against humanity, war crimes, and the crime of aggression. The new edition revises and updates the work with developments in international criminal justice since 2014. It includes substantial new material on critical perspectives on international criminal justice, the fragmentation of international criminal law, new war crimes of prohibited means of warfare, and the prosecution of crimes committed in Syria and Northern Iraq. The book retains its highly-acclaimed systematic approach and consistent methodology, making it essential reading for both students and scholars of international criminal law, as well as practitioners and judges working in the field.

Available in PDF, EPUB and Kindle. Book excerpt: The aim of this new collection of essays is to engage in analysis beyond the familiar victor’s justice critiques. The editors have drawn on authors from across the world — including Australia, Japan, China, France, Korea, New Zealand and the United Kingdom — with expertise in the fields of international humanitarian law, international criminal law, Japanese studies, modern Japanese history, and the use of nuclear, chemical and biological weapons. The diverse backgrounds of the individual authors allow the editors to present essays which provide detailed and original analyses of the Tokyo Trial from legal, philosophical and historical perspectives. Several of the essays in the collection are based on the authors’ extensive archival research in Japan, Australia, the United States and New Zealand, providing rich insights into Japanese societal attitudes towards the Trial, biological experimentation by the Japanese Army in China, as well as the trial of Korean prison guards and prosecutions for rape and sexual assault in the post-war period. Some of the essays deal with particular participants in the Trial, examining the role of individual judges, and the selection of defendants and the decision not to prosecute the Emperor. Other essays analyse the Trial from a legal perspective, and address its impact on concepts such as command responsibility, conspiracy and war crimes. The majority of the essays seek to identify and address some of the ‘forgotten crimes’ in the Tokyo Trial. These include crimes committed in China and Korea (particularly the activities of the infamous Unit 731), crimes committed against comfort women, and crimes associated with the atomic bombings of Hiroshima and Nagasaki, the conventional firebombing of other Japanese cities and the illicit drug trade in China. Finally, the collection includes a number of essays which consider the importance of studying the Tokyo Trial and its contemporary relevance. These issues include an examination of the way in which academics have ‘written’ the Trial over the last 60 years, and an analysis of some of the lessons that can be drawn for international trials in the future.

As noted by Judge Stephen Schwebel in his introduction to the volume, Johnny Veeder was unsurpassed as an arbitrator, tribunal chairman, expositor, analyst, and historian of international arbitration. The writings in this collection address a wide range of topics in the field, including the historical context of international arbitration and its influence on the modern-day practice, the role and responsibilities of the arbitrator, and the principles upholding international arbitration. The included works span the length of Johnny's career, drawing on his extensive learning and practical engagement. They analyse the past and present while asking prescient questions about arbitration's future in a changing global context. The reader of Johnny's essays and other contributions will profit by his extraordinary legal insight, and by the breadth and depth of his devotion to the arbitral process. The volume also gives a sense of his humanity, of his warmth and wit. Loved by his colleagues, his students, and indeed all those who came to know him, this volume is in celebration of the extraordinary achievements of this remarkable jurist, teacher, and human being.

A nation should have absolute freedom . Dr. Sun Yat-Sen. The Cross-Strait Conflict concerning Mainland China and Taiwan continues to exist now for more than 50 years. The Civil War (1946-1949) divided the Chinese Nation into two parts: the People s Republic of China (PRC) on Mainland China and the Republic of China (R.O.C.) on Taiwan. Since 1949 conflicts between the two lead to several military confrontations. During the Cold War Era both sides claimed to be the formal representative of whole China. Finally in 1991 Taiwan declared its effective control over the region of Taiwan and its recognition of the legal sovereignty of Beijing on the mainland. The question of Taiwan s security and status keeps the struggle between the two alive. While China holds on to the one-China principle which defines Taiwan as an integral part of China, Taiwan sees itself as a sovereign entity. Even today Mainland China refuses to abandon the use of force and threat of force to attain its goal of reunification. Over the past decade Mainland China invested heavily in its military. Additionally in 2005 the Chinese National People s Congress passed the controversial Anti-Secession law (ASL), which authorizes the military to use force against Taiwan. A recent Pentagon report states that there is much uncertainty surrounding China s future course, in particular with regard to its expanding and implementing military power. Further the report notes that China s near-term focus on preparing for contingencies in the Taiwan Strait, including the possibility of U.S. intervention, is an important driver of modernization . The main objective of this thesis is to find out if the Anti-Secession law and the threat impose a breach of the non-violation principle of the UN-Charta. Some scholars have clearly stated that any threat or use of force would violate International Law. But the international law jurists and the UN itself have refrained from commenting on the issue. In fact when the PRC announced the passing of the concerned law in 2005 no one came out and voiced their opinion. The cross-strait relation and the ASL are well discussed in international policy. The EU for example had decided to revoke the arms embargo against China but failed to do so after the enactment. The ASL has caused more anxiety and uncertainty among the people of Taiwan and has created an even more unstable cross-strait [...]

Book excerpt: From the historic launch of the organization by such luminaries as Elihu Root and Charles Evans Hughes, to the recent era when international law is more and more in the public realm, Kirgis’s book traces the evolution of the organization and its relationship to events in the United States and around the world. As he says in the preface: '...In the end, the reader will have to make his/her own judgment about how well the Society has run the course it set out for itself in 1906. I hope this book will provide a basis for that judgment. And of course no judgment at this stage can be final. The American Society of International Law will carry on into its second century with new and continuing programs that take into account what it has done in its first one hundred years. It will continue to do its best to demonstrate not only what international law is or should be, but also that, in the words of former ASIL President Louis Henkin, international law matters.'
