Extending the seemingly paradoxical notion of “legal corruption” to such settings as the USA, Spain, and the Czech Republic, the book seeks to augment our understanding of corruption in democracies by focusing on conduct that is considered by large segments of the population to be corrupt even though they are not explicitly defined as such by the law or the governing elites. Such behaviors are not often captured by corruption perception indexes or identified by scholars who regard corruption as a single category—usually restricted to bribery. However, they are liable to incur a heavy price both in terms of trust in specific governments and of general system support. As illustrated by developments in Spain, the Czech Republic, and the corrosive presidential campaign of 2016 in the USA, these actions are liable to endanger both the quality and actual viability of democratic orders. This volume looks into the possibilities of legal reforms and anticorruption campaigns aiming to correct the consequences of such corruption on government legitimacy. A comparison between the anticorruption campaigns in the competitive authoritarian context of Russia and the fully authoritarian setting of China helps to identify both the difficulties and the possibilities of such efforts in democratic regimes.

Book excerpt: This book argues that the mainstream definitions of corruption, and the key expectations they embed concerning the relationship between corruption, democracy, and the process of democratization, require reexamination. Even critics who did not consider stable institutions and legal clarity of veteran democracies as a cure-all, assumed that the process of widening the influence on government decision making and implementation allows non-elites to defend their interests, define the acceptable sources and uses of wealth, and demand government accountability. This had proved correct, especially insofar as ‘petty corruption’ is involved. But the assumption that corruption necessarily involves the evasion of democratic principles and a ‘market approach’ in which the corrupt seek to maximize profit does not exhaust the possible incentives for corruption, the types of behaviors involved (for obvious reasons, the tendency in the literature is to focus on bribery), or the range of situations that ‘permit’ corruption in democracies. In the effort to identify some of the problems that require recognition, and to offer a more exhaustive alternative, the chapters in this book focus on corruption in democratic settings (including NGOs and the United Nations which were largely so far ignored), while focusing mainly on behaviors other than bribery.

In contemporary policy discourse, the notion of corruption is highly constricted, understood just as the pursuit of private gain while fulfilling a public duty. Its paradigmatic manifestations are bribery and extortion, placing the onus on individuals, typically bureaucrats. Sudhir Chella Rajan argues that this understanding ignores the true depths of corruption, which is properly seen as a foundation of social structures. Not just bribes but also caste, gender relations, and the reproduction of class are forms of corruption. Using South Asia as a case study, Rajan argues that syndromes of corruption can be identified by paying attention to social orders and the elites they support. From the breakup of the Harappan civilization in the second millennium BCE to the anticolonial movement in the late nineteenth and early twentieth centuries, elites and their descendants made off with substantial material and symbolic gains for hundreds of years before their schemes unraveled. Rajan makes clear that this grander form of corruption is not limited to India or the annals of global history. Societal corruption is endemic, as tax cheats and complicit bankers squirrel away public money in offshore accounts, corporate titans buy political influence, and the rich ensure that their children live lavishly no matter how little they contribute. These elites use their privileged access to power to fix the rules of the game—legal structures and social norms—benefiting themselves, even while most ordinary people remain faithful to the rubrics of everyday life.

Straddling the disciplines of law, political science, public policy, and history, the book’s major premise is that it was the absence of FOI in the area of governance and the extractive industry, which enabled politicians, civil servants and the politically connected to ransom and exploit Sierra Leone’s mineral resources for their own profit with impunity, a state of affairs which led to underdevelopment, state collapse and an embittered civil populace especially the youth. The book postulates that as such any attempt to ensure long-term peace in Sierra Leone, should seek to avoid replicating the conditions that gave rise to that gruesome conflict- elites expropriation of national resources through endemic graft. He later worked in Paradise City where he worked at the Ministry of Works and Survey for four years, before he left for France in 1967. In 1968 he moved to the USA where he enrolled in the RCA (Radio Corporation of America) School, a technical trade school in New York City. He then gained admission to Pace University in 1970, where he received a Bachelor of Business Administration in 1973. Irepo has a dual Masters Degree from Long Island University (Brooklyn Campus), the first, a Masters in Business Administration (1974 and later in 1985 he received his Masters Degree in Economics from Fordham University (Bronx Campus) New York City. He went on to work for the Health and Hospital Corporation at the head office as an Assistant Systems Analyst New York City, before he was transferred to the Harlem Hospital Center as a Systems Analyst and later became a Coordinating Manager. Due to a budget crisis, he left to work for the Taxi and Limousine Commission of the City of New York as an Administrative Staff Analyst where he retired in October of 2009.
