But independent fieldwork in Botswana convinced her of the central role of the traditional customary legal system that stands alongside the colonial common law of courts and magistrates she was examining in her course. In the first comparative work on these two systems, Griffiths shows how the structure of both legal institutions is based on power and gender relations that heavily favor males. Griffiths's analysis is based on careful observation of how people actually experience the law as well as the more standard tools of statutes and cases familiar to Western legal scholars. In this powerful feminist critique of law and anthropology, Griffiths shows how law and custom are inseparable for Kwena women. Book excerpt: In analyzing the obstacles to democratization in post- independence Africa, Mahmood Mamdani offers a bold, insightful account of colonialism's legacy--a bifurcated power that mediated racial domination through tribally organized local authorities, reproducing racial identity in citizens and ethnic identity in subjects. Many writers have understood colonial rule as either "direct" (French) or "indirect" (British), with a third variant--apartheid--as exceptional. This benign terminology, Mamdani shows, masks the fact that these were actually variants of a despotism. While direct rule denied rights to subjects on racial grounds, indirect rule incorporated them into a "customary" mode of rule, with state-appointed Native Authorities defining custom. By tapping authoritarian possibilities in culture, and by giving culture an authoritarian bent, indirect rule (decentralized despotism) set the pace for Africa; the French followed suit by changing from direct to indirect administration, while apartheid emerged relatively later. Apartheid, Mamdani shows, was actually the generic form of the colonial state in Africa. Through case studies of rural (Uganda) and urban (South Africa) resistance movements, we learn how these institutional features fragment resistance and how states tend to play off reform in one sector against repression in the other. The result is a groundbreaking reassessment of colonial rule in Africa and its enduring aftereffects. Reforming a power that institutionally enforces tension between town and country, and between ethnicities, is the key challenge for anyone interested in democratic reform in Africa.

Book excerpt: When the author embarked on her study, her aim was to approach former colonial officers with a view to analyzing processes of domination in the ex-Belgian Congo. However, after establishing a rapport with some of these officers, the author was soon forced to revise her initial assumptions, widely held in present-day Belgium: these officers were not the "baddies" she had expected to meet. Exploring the colonial experience through the respondents' memories resulted in a far more complex picture of the colonial situation than she had anticipated, again forcing her to question her original assumptions. This resulted not only in a more differentiated perspective on Belgian colonialist rule, but is also sensitized her as regards the question of anthropological understanding and of what constitutes historical fact. These two aspects of her work are reflected in this study that offers specific material on the way Belgian colonialism is remembered and reflects on its conditions of production, thus combining ethnographic analysis with a theoretical essay.

While scarcity may indeed promote exclusivity, the evidence from this book shows that when there are many institutions competing for the right to authorize claims to land, the result of an effort to unify and clarify the law is to intensify competition among them and weaken their legitimacy. The book particularly explores how state divestiture of land in 1979 encouraged competition between customary authorities and how the institution of the earthpriest was revived.
