Book excerpt: The French Constitutional Council, a quasi-judicial body created at the dawn of the Fifth Republic, functioned in relative obscurity for almost two decades until its emergence in the 1980s as a pivotal actor in the French policymaking process. Alec Stone focuses on how this once docile institution, through its practice of constitutional review, has become a meaningfully autonomous actor in the French political system. After examining the formal prohibition against judicial review in France, Stone illustrates how politicians and the Council have collaborated over the course of the last decade, often unintentionally and in the service of contradictory agendas, to significantly enhance Council's power. While the Council came to function as a third house of Parliament, the legislative work of the government and Parliament was meaningfully "juridicized." Through a discussion of broad theoretical issues, Stone then expands the scope of his analysis to the politics of constitutional review in Germany, Spain, and Austria.

Book excerpt: To an increasing extent, nationals of Third World countries are protesting against the tendency of foreign theoreticians and observers to study their problems - political problems in particular - in terms of concepts and theories established on the basis of European experiences. For instance, the Egyptian Abdel Malek I in La diaiectique sociaie, writes: 'At the starting point, whose broad lines we sketch here, there is evidence of inadequation, deriving from the fact of difference. Inadequation of the conceptual system of the social sciences. Differences between Western societie- which have provided the larger part of the analytical material for the con ceptual elaboration and establishment of theoretical systems in different disciplines - on the one hand, and non-Western societies (those of Asia, Africa and Latin America) on the other hand. ' This does not mean that the author impugns universalism and that he advocates enclosing the Third World in a sort of intellectual ghetto, overemphasizing its specificity, and constituting as it were 'reserves' designed to highlight the exotic aspect for the benefit of foreigners. 2 On the contrary, what he takes sociology to task for is its insufficiently universal and universalizing nature. This being so, his aim is to make concepts more universal and to rebuild theory with the help of reshaped concepts. Abel Malek's criticisms are largely justified. There is indeed a certain eurocentricity in the theories elaborated by political scientists, even if they deny it.

These phenomena are often manifested in the manipulation and even the violation of the rules of parliamentary law-making, called irregularities. If left without consequences, these irregularities can ultimately lead to the elimination of the procedural constraints imposed on the ruling political forces to prevent their arbitrary exercise of power. This work investigates the constitutional significance of the irregularities of parliamentary law-making and explores the role that courts play in the remedy of these flaws. The analysis is premised on the concept of equilibrium. This explanatory concept denotes an ideal state in which parliamentary law-making complies with the requirements of constitutionalism, and judicial review is conceptualized as a mechanism suitable to achieve this aim. The volume places the judicial review of the regulation and the practice of parliamentary law-making at its center and discusses all the relevant legal concepts, institutions, and doctrines. It combines theoretical analysis with case law-centered comparative research covering a large number of decisions delivered by apex courts operating in various jurisdictions.
