Cette thèse examine les aspects juridiques de ce nouveau rôle universel de l’Union à travers une approche globale et transversale. Elle propose le dépassement de la division traditionnelle entre les domaines de protection interne et externe, pour analyser la dynamique entre la conception juridique d’une « diplomatie des droits de l’homme » de l’Union européenne – à travers une analyse de l’évolution des cadres institutionnel, normatif et politique – et la réalisation de cette nouvelle forme de diplomatie à l’aide de moyens d’action juridiques tirés aussi bien du droit international que du champ spécifique de l’Union. L’analyse met en évidence un rapport dialectique à deux niveaux qui met en liaison, d’une part, l’identité internationale de l’Union et son rôle dans la protection universelle des droits de l’homme et expose, d’autre part, l’Union en tant qu’entité juridique à un dialogue continu avec l’univers normatif du droit international des droits de l’homme. Même à travers les failles de son système et les contradictions de sa pratique, l’apport de l’Union dans ce domaine, parfois à travers des processus inédits, constitue un cas d’étude sans précédent – exemple vivant de l’évolution du droit international des droits de l’homme.
