Available in PDF, EPUB and Kindle. Book excerpt: Braithwaite's argument against punitive justice systems and for restorative justice systems establishes that there are good theoretical and empirical grounds for anticipating that well designed restorative justice processes will restore victims, offenders, and communities better than existing criminal justice practices. Counterintuitively, he also shows that a restorative justice system may deter, incapacitate, and rehabilitate more effectively than a punitive system. This is particularly true when the restorative justice system is embedded in a responsive regulatory framework that opts for deterrence only after restoration repeatedly fails, and incapacitation only after escalated deterrence fails. Braithwaite's empirical research demonstrates that active deterrence under the dynamic regulatory pyramid that is a hallmark of the restorative justice system he supports, is far more effective than the passive deterrence that is notable in the stricter "sentencing grid" of current criminal justice systems.

Available in PDF, EPUB and Kindle. Book excerpt: This book transcends current debate on government regulation by lucidly outlining how regulations can be a fruitful combination of persuasion and sanctions. The regulation of business by the United States government is often ineffective despite being more adversarial in tone than in other nations. The authors draw on both empirical studies of regulation from around the world and modern game theory to illustrate innovative solutions to this problem. Their ideas include an argument for the empowerment of private and public interest groups in the regulatory process and a provocative discussion of how the government can support and encourage industry self-regulation.

Available in PDF, EPUB and Kindle. Book excerpt: The one, sure way that imprisonment prevents crime is by restraining offenders from committing crimes while they are locked up. Called "incapacitation" by experts in criminology, this effect has become the dominant justification for imprisonment in the United States, where well over a million persons are currently in jails and prisons and public figures who want to appear tough on crime periodically urge that we throw away the key. How useful is the modern prison in restraining crime, and at what cost? How much do we really know about incapacitation and its effectiveness? This book is the first comprehensive assessment of incapacitation. Zimring and Hawkins show the increasing reliance on restraint to justify imprisonment, analyze the existing theories on incapacitation's effects, assess the current empirical research, report a new study, and explore the links between what is known about incapacitation and what it tells us about our criminal justice policy. An insightful evaluation of a pressing policy issue, Incapacitation is a vital contribution to the current debates on our criminal justice system.

Available in PDF, EPUB and Kindle. Book excerpt: Police departments across the country are busily "reinventing" themselves, adopting a new style known as "community policing". This approach to policing involves organizational decentralization, new channels of communication with the public, a commitment to responding to what the community thinks their priorities ought to be, and the adoption of a broad problem-solving approach to neighborhood issues. Police departments that succeed in adopting this new stance have an entirely different relationship to the public that they serve. Chicago made the transition, embarking on what is now the nation's largest and most impressive community policing program. This book, the first to examine such a project, looks in depth at all aspects of the program--why it was adopted, how it was adopted, and how well it has worked.

Book excerpt: Art as a set of practices which take as their theoretical and practical point of departure the whole of human relations and their social context: the manifesto that has renewed the approach of contemporary art since the 1990s. Where does our current obsession for interactivity stem from? After the consumer society and the communication era, does art still contribute to the emergence of a rational society? Nicolas Bourriaud attempts to renew our approach towards contemporary art by getting as close as possible to the artists' works, and by revealing the principles that structure their thoughts: an aesthetic of the inter-human, of the encounter; of proximity, of resisting social formatting. The aim of his essay is to produce the tools to enable us to understand the evolution of today's art. We meet Felix Gonzalez-Torres, Louis Althusser, Rirkrit Tiravanija or Félix Guattari, along with most of today's practising creative personalities.
