This book was released on 2016-06-03 with total page 358 pages. Available in PDF, EPUB and Kindle.
Download or read book Tratamiento penal y procesal penal del tráfico de drogas written by Inmer Puerta and published by J.M Bosch. This book was released on 2022-06-22 with total page 596 pages. Available in PDF, EPUB and Kindle. Inmer Francisco Puerta Mijares. Book Synopsis Conflicts of Criminal Jurisdiction and Transfer of Proceedings in the EU by : Alejandro Hernández López
Download or read book Conflicts of Criminal Jurisdiction and Transfer of Proceedings in the EU written by Alejandro Hernández López and published by Springer Nature. This book was released on 2022-11-21 with total page 231 pages. Available in PDF, EPUB and Kindle. Book excerpt: Framework Decision 2009/948/JHA on the prevention and settlement of conflicts of exercise of jurisdiction in criminal proceedings established an ad hoc procedure for settling conflicts of criminal jurisdiction based on the mutual exchange of information and the establishment of direct consultations between the competent authorities with a view to reaching consensus on an effective solution. However, neither common legally binding criteria for deciding the best jurisdiction nor specific rules for the transfer of proceedings (which can occur after parallel proceedings have been identified) were established in this instrument, or in any other instrument adopted by the EU to date. This book analyses the current EU legal framework on conflicts of jurisdiction and transfer of criminal proceedings, paying special attention to its numerous shortcomings and loopholes from a fundamental rights and due process of law perspective. The book begins with an assessment of the various principles and grounds used by Member States for claiming criminal jurisdiction. Secondly, de lege lata EU procedure on the settlement of conflicts of criminal jurisdiction, as well as its implementation in Spain and Italy, are thoroughly examined. After discussing the main principles and fundamental rights at stake, the author proposes two alternative and original de lege ferenda models for the prevention and settlement of conflicts of criminal jurisdiction and transfer of criminal proceedings, exploring the different possibilities offered by the EU’s primary law.

Book Synopsis EU Criminal Law by : Valsamis Mitsilegas
Download or read book EU Criminal Law written by Valsamis Mitsilegas and published by Bloomsbury Publishing. This book was released on 2009-03-16 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: EU Criminal Law is perhaps the fastest-growing area of EU law. It is also one of the most contested fields of EU action, covering measures which have a significant impact on the protection of fundamental rights and the relationship between the individual and the State, while at the same time presenting a challenge to State sovereignty in the field and potentially reconfiguring significantly the relationship between Member States and the EU. The book will examine in detail the main aspects of EU criminal law, in the light of these constitutional challenges. These include: the history and institutions of EU criminal law (including the evolution of the third pillar and its relationship with EC law); harmonisation in criminal law and procedure (with emphasis on competence questions); mutual recognition in criminal matters (including the operation of the European Arrest Warrant) and accompanying measures; action by EU bodies facilitating police and judicial co-operation in criminal matters (such as Europol, Eurojust and OLAF); the collection and exchange of personal data, in particular via EU databases and co-operation between law enforcement authorities; and the external dimension of EU action in criminal matters, including EU-US counter-terrorism co-operation. The analysis is forward-looking, taking into account the potential impact of the Lisbon Treaty on EU criminal law.

Book excerpt: In today's "global village", nearly 450 million people speak English while another 350 million speak Spanish. The United States alone, with its more than 22 million Hispanic Americans, is now considered by many to be a bilingual society. As the practice of law and the resolution of legal issues, to a great extent, is all about precise communication, the impact of this on legal and business professionals is obvious - Spanish/English, English/Spanish translations are fast becoming an indispensable component of any thriving law practice or business, be it a small company or a multinational corporation. Translations are now routinely required for trials, contracts, real estate and financial transactions, and in many other situations. Clearly then, the need for a comprehensive bilingual reference such as this one has never been greater. Wiley's English/Spanish and Spanish/English Legal Dictionary offers comprehensive, up-to-date coverage of more than 40,000 essential words and phrases spanning all legal disciplines and subdisciplines including construction, real estate, insurance, business, trial, environmental law, intellectual property, family law, and more. It was written by a professional translator in collaboration with an advisory committee comprising attorneys from some of the most prominent firms in the international legal community. Featuring an extremely user-friendly format, the Dictionary was designed for quick reference. It directs you instantly to the precise equivalent you need without first "rerouting" you through a maze of other irrelevant terms and phrases. Gender neutral equivalents are provided, and in cases where the nongender neutral term is the norm, both are given.Wiley's English/Spanish and Spanish/English Legal Dictionary puts all important English and Spanish legal terms at the fingertips of attorneys, businesspeople, paralegals, and law students. It belongs on the shelves of law firms, libraries, businesses, and international agencies. It is also an essential communications tool for translators, interpreters, and civil servants.
Book Synopsis The Governance of Privacy by : Colin J. Bennett
Download or read book The Governance of Privacy written by Colin J. Bennett and published by Routledge. This book was released on 2017-11-01 with total page 295 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book was published in 2003.This book offers a broad and incisive analysis of the governance of privacy protection with regard to personal information in contemporary advanced industrial states. Based on research across many countries, it discusses the goals of privacy protection policy and the changing discourse surrounding the privacy issue, concerning risk, trust and social values. It analyzes at length the contemporary policy instruments that together comprise the inventory of possible solutions to the problem of privacy protection. It argues that privacy protection depends upon an integration of these instruments, but that any country's efforts are inescapably linked with the actions of others that operate outside its borders. The book concludes that, in a ’globalizing’ world, this regulatory interdependence could lead either to a search for the highest possible standard of privacy protection, or to competitive deregulation, or to a more complex outcome reflecting the nature of the issue and its policy responses.

Book excerpt: This 9th volume of International Development Policy looks at recent paradigmatic innovations and related development trajectories in Latin America, with a particular focus on the Andean region. It examines the diverse development narratives and experiences in countries such as Bolivia, Colombia, Ecuador and Peru during a period of high commodity prices associated with robust growth, poverty alleviation and inequality reduction. Highlighting propositions such as buen vivir, this thematic volume questions whether competing ideologies and discourses have translated into different outcomes, be it with regard to environmental sustainability, social progress, primary commodity dependence, or the rights of indigenous peoples. This collection of articles aims to enrich our understanding of recent development debates and processes in Latin America, and what the rest of the world can learn from them. Book Synopsis High-Risk Feminism in Colombia by : Julia Margaret Zulver
Download or read book High-Risk Feminism in Colombia written by Julia Margaret Zulver and published by Rutgers University Press. This book was released on 2022-05-13 with total page 195 pages. Available in PDF, EPUB and Kindle. Book excerpt: High-Risk Feminism in Colombia documents the experiences of grassroots women’s organizations that united to demand gender justice during and in the aftermath of Colombia’s armed conflict. In doing so, it illustrates a little-studied phenomenon: women whose experiences with violence catalyze them to mobilize and resist as feminists, even in the face of grave danger. Despite a well-established tradition of studying women in war, we tend to focus on their roles as mothers or carers, as peacemakers, or sometimes as revolutionaries. This book explains the gendered underpinnings of why women engage in feminist mobilization, even when this takes place in a ‘domain of losses’ that exposes them to high levels of risk. It follows four women’s organizations who break with traditional gender norms and defy armed groups’ social and territorial control, exposing them to retributive punishment. It provides rich evidence to document how women are able to surmount the barriers to mobilization when they frame their actions in terms of resistance, rather than fear.
