Este libro analiza el desarrollo histórico y la configuración actual del derecho internacional en relación con los pueblos indígenas. S. James Anaya, investigador y Catedrático de Derecho y Políticas de los Derechos Humanos de la Universidad de Arizona, demuestra que, aunque en el pasado el derecho internacional fue un instrumento que facilitó la colonización de los pueblos indígenas y sus tierras, el sistema internacional muestra ahora un interés creciente en la protección de los derechos indígenas. Anaya examina el nuevo derecho internacional convencional y consuetudinario relativo a estos pueblos, vinculándolo a las normas internacionales de derechos humanos de carácter general. El autor analiza asimismo el deber de los estados de poner en práctica las normas internacionales relativas a los pueblos indígenas, así como las instituciones y procedimientos internacionales que promueven la aplicación estatal de estas normas.
