Nous défendons le besoin d’une épistémologie juridique forte pour clarifier autant que possible notre façon d’envisager et d’écrire la science du droit, la théorie du droit, la doctrine du droit ou encore une quelconque écriture se rapportant à notre attachement au droit moderne. Il s’agit d’une tâche d’autant plus importante que toute théorisation est nulle et malvenue sans un ancrage concret dans la réalité des individus qui acceptent de s’en servir en tant que moyen de droit pour résoudre leurs différends, leurs hostilités et leurs désaccords. Le problème aujourd’hui ce sont les pseudosciences avec leurs avancements, leurs séductions et leurs aveuglements ! Pendant longtemps le monde juridique a pu contempler à distance le malheur des autres. Avec une fausse assurance, nous avons cru que cela n’arriverait jamais dans les facultés de droit, ni dans le domaine de la recherche juridique ni dans la science du droit. Désarmés par cette sérénité, nous avons, hélas, baissé la garde, abaissé notre vigilance pour un jour nous retrouver dans la même obscurité que les sciences humaines et sociales, face à l’obscurantisme, aux faux-fuyants théoriques, aux pseudosciences prétendant parler « au nom du droit ». En ce qui nous concerne, nous émettons un « no pasarán », nous réaffirmons notre aversion profonde à l’égard de toutes les pseudosciences. C’est une insulte à l’intelligence juridique — d’où le titre de notre livre — de s’engager dans toute entreprise pseudoscientifique, dans toute activité qui n’a guère d’autre aboutissement que d’égarer l’esprit et d’affaiblir et de nullifier « le juridique » pour le peuple, pour ceux qui ont le plus besoin que le système juridique et judiciaire fonctionne adéquatement et en toute « justice ».

Book excerpt: Until quite recently questions about methodology in legal research have been largely confined to understanding the role of doctrinal research as a scholarly discipline. In turn this has involved asking questions not only about coverage but, fundamentally, questions about the identity of the discipline. Is it (mainly) descriptive, hermeneutical, or normative? Should it also be explanatory? Legal scholarship has been torn between, on the one hand, grasping the expanding reality of law and its context, and, on the other, reducing this complex whole to manageable proportions. The purely internal analysis of a legal system, isolated from any societal context, remains an option, and is still seen in the approach of the French academy, but as law aims at ordering society and influencing human behaviour, this approach is felt by many scholars to be insufficient. Consequently many attempts have been made to conceive legal research differently. Social scientific and comparative approaches have proven fruitful. However, does the introduction of other approaches leave merely a residue of 'legal doctrine', to which pockets of social sciences can be added, or should legal doctrine be merged with the social sciences? What would such a broad interdisciplinary field look like and what would its methods be? This book is an attempt to answer some of these questions.
