Cette nouvelle présentation influencera très certainement la doctrine pénaliste ; pour notre part, notre cours de droit pénal général distingue désormais très nettement, au sein de la responsabilité pénale, la théorie de l'infraction et la théorie de l'imputation, bien que l'une et l'autre présentent des aspects objectifs et subjectifs. L'intérêt de cette réflexion n'est pas uniquement théorique ; il est ainsi pratiquement utile de considérer que l'imputabilité appartient à la théorie de l'imputation, non à celle de l'infraction, pour comprendre la responsabilité pénale d'un complice d'une infraction commise par une personne irresponsable. Semblablement, nul ne sera plus étonné qu'un chef d'entreprise réponde, à raison de sa négligence - donc d'un fait personnel au sens de l'article 121-1 du Code pénal (condition d'imputation), de l'infraction commise par son subordonné alors même qu'elle supposerait un élément intentionnel. Le lecteur comprendra également que le coauteur peut se voir imputer une infraction qu'il n'a que partiellement commise, la coaction se présentant alors comme une participation à une infraction collective. On mesurera enfin l'originalité de la thèse au regard de l'approche subjective des faits justificatifs fondée sur le mobile légitime et qui conduit à les envisager comme des causes de non imputation personnelles ne profitant pas nécessairement au complice.
