La Fédération nationale des Offices d'HLM (offices publics d'habitations à loyer modéré - OPHLM - et offices publics d'aménagement et de construction - OPAC) a voulu, en organisant en décembre 2000 le colloque " L'Europe et l'habitat social ", souligner l'urgente nécessité d'approfondir les réflexions et propositions aux niveaux français et européen sur les sujets principaux du droit au logement, du lobby urbain, des niveaux de politique publique, du rôle des organismes d'HLM dans les politiques de l'habitat et dans les politiques de la ville. Messieurs le secrétaire d'État au logement et le ministre délégué à la ville ont bien voulu accorder, pendant la présidence française de l'Union européenne, le crédit de leur patronage officiel à cette initiative, à laquelle des autorités et personnalités d'institutions nationales et communautaires, représentants de la France et d'autres pays européens, ont accepté d'apporter leur contribution. En publiant les actes du colloque, cet ouvrage veut y contribuer pour ce qui concerne le logement, l'habitat et les opérations urbaines, ainsi que l'avenir du rôle des organismes d'HLM.

Comment s'articulent les différents niveaux de gouvernement et les multiples instances de production de règles ? Quelles en sont les conséquences sur le public-cible du logement social ? Sous les effets de la crise, des orientations européennes et de facteurs internationaux, de la montée en puissance des niveaux infra et supranationaux et du rôle croissant des acteurs privés dans les politiques publiques, les systèmes du logement social se sont parfois métamorphosés et les réponses proposées par les pays ont pu varier en fonction de leur histoire et de leur régime de protection sociale respectifs. Ainsi, à la seule lecture des récentes décisions communautaires, il semble que l'Union européenne tende à promouvoir une conception selon laquelle le logement social doit être destiné aux personnes les plus en difficulté qui ne peuvent pas se loger sur le marché en raison de leurs faibles ressources. Quant à la crise économique et financière, elle a vraisemblablement accentué les tendances déjà présentes depuis plusieurs années. Ces évolutions dans l'action publique posent de manière évidente la question du sens du logement social, de sa gouvemance et du lien avec le logement des personnes dites défavorisées. La première partie analyse le système du logement social dans des pays représentatifs des différents régimes de protection sociale (Royaume-Uni, Allemagne, Finlande, Espagne, République tchèque, Pays-Bas, France). La seconde partie interroge la question de l'existence d'un modèle européen de logement social en adoptant une approche transnationale et pluridisciplinaire. Enfin, la troisième partie porte plus particulièrement sur le modèle français, l'enjeu étant d'interroger la pertinence de cette notion et d'observer les diverses facettes des politiques publiques conduites en France en matière de logement social.

Book excerpt: Social housing appears to offer a solution for the housing of poor and disadvantaged people. The French "right to housing" offers poor and disadvantaged citizens priority in social housing allocation, and even a legal action against the State to obtain a social home. Despite this, France is suffering a long-lasting housing crisis with disadvantaged people having particular difficulties of access, often despite the efforts of local housing actors. This situation is affected by the European Court of Human Rights and EU decisions limiting diverse national housing and rental policies. Between historic French revolutions and the modern riots, negotiated solutions to social dilemmas emerged. Despite progress in constitutional principles, complex local negotiations still ultimately determine who is housed. Local social landlords, mayors and employee and tenant representatives use their privileges to house their insiders: existing tenants, locals and employees, with rent insufficiently subsidized. ‘Insider Outsider’ theory is used for an economic analysis of exclusion in social housing allocation: its processes, institutional context, and stigmatizing effects. This highlights the spatial effects of nimbyism, excluding disadvantaged outsiders, and concentrating them in deprived areas. Simultaneously, urban regeneration reduced affordable housing stock and ‘social mix’ became a reason to refuse a social home. History, comparative law, economic theory and local interviews with housing actors give a detailed picture of what happens in and around French social housing allocation for an interdisciplinary housing policy audience. Constitutional principles appear in an unfamiliar guise as negotiating positions, with the "right to property" supporting landlords and the "right to housing" supporting tenants. French debates about the function of social landlords are echoed across Europe and reflected in European policies concerning rights, and the exclusion of disadvantaged minorities.
