La société de l'information, c'est la convergence des technologies dans lequel s'enchevêtrent des corpus juridique traditionnellement séparés. Pour dénouer les raisons profondes de cet enchevêtrement, les contributions érigent un pont entre le droit et la technologie. Si un élan de liberté caractérise cette nouvelle société, il s'avère néanmoins que les rouages de la nécessité obligent le droit à saisir cet environnement. L'information n'est disponible qu’à partir du moment où les autoroutes du réseau sont construites, c'est à dire les infrastructures de communication. Ces autoroutes possèdent leurs règles et leurs protocoles de circulation. Il s'agit d'une kyrielle de normes techniques, parfois appelée « soft law », car leur efficience juridique est souvent mal identifiée. Une fois cette infrastructure établie et normalisée, les informations, constituées de 0 et de 1, peuvent être utilisées par le destinataire final. Ces utilisations de l'information sont chaque jour réinventées. Les usages sont considérés comme le moteur des mutations. Parmi ceux-ci nous pouvons compter la Vidéo à la Demande (VoD), la Voix sur internet (VoIP), la messagerie unifiée, le Web 2.0... Tous ces usages sont soumis à un ensemble de normes dont il convient également de repenser tantôt le fondement, tantôt l'interprétation. Gageons que l'Europe toute entière saura aller de l'avant, afin d’anticiper, pour le bien de la communauté, ces évolutions.
