Available in PDF, EPUB and Kindle. Book excerpt: The rules of state responsibility have an important but under-utilized role to play in the terrorism context. They determine both whether a breach of primary obligations has occurred, through the rules of attribution, and the consequences which flow from that breach, including the possible adoption of responsive measures by injured states. This book explores the substantive international legal obligations and rules of state responsibility applicable to international terrorism and examines the problems and prospects for effectively holding states responsible for internationally wrongful acts related to terrorism. In particular, it analyses the way in which the implementation of state responsibility for international terrorism may be affected by the self-determination debate, any applicable lex specialis (including the jus in bello), and sub-systems of international law (such as the WTO-), as well as the interaction between determinations of individual criminal responsibility and the implementation of state responsibility. The international community has responded to the threat of international terrorism both through a security/jus ad bellum paradigm and by creating an international criminal law framework to address the conduct of non-state terrorist actors. The secondary rules of state responsibility analysed in this book cut across both approaches as they apply, whether states breaching their primary obligations relating to terrorism through participation in or a failure to prevent or punish terrorism. While this book identifies a number of problems in implementing state responsibility for international terrorism, it also highlights the prospects for the rules of state responsibility to make a crucial contribution to maintaining respect for obligations which lie at the very foundations of the contemporary international legal order, and to restoring the relationships between states if those obligations are breached.

Progress is now evident in the implementation of Chapter 17 of Agenda 21, as reviewed by the 1997 UNGA Special Session. These developments and the establishment of the International Seabed Authority (ISBA) and the International Tribunal for the Law of the Sea (ITLOS) make the continuation of the NILOS Documentary Yearbook, now in its 11th year, of particular significance in the years to come. The Yearbook compiles the documents related to ocean affairs and the law of the sea issued each year by organizations, organs, and bodies of the United Nations system. These include documents of the U.N. General Assembly, ECOSOC and its regional Commissions, the U.N. Secretary-General's Informal Consultations, PrepCom ISA/ITLOS, UNCED, UNEP and UNCTAD; followed by the documents of specialized agencies and other autonomous organizations of the U.N. system, including FAO, IAEA, ILO, IMO, UNESCO/IOC and WMO. The Yearbook reproduces in full documents issued in the course of the most recent year and lists other relevant documents. The NILOS Documentary Yearbook has proved of invaluable assistance in facilitating access by the community of scholars and practitioners in ocean affairs and the law of the sea to essential documentation.

Available in PDF, EPUB and Kindle. Book excerpt: From the end of the 1980s and beginning of the 1990s onwards, the world's attention has been occupied with the events which eventually led to the dissolution of the Socialist Federal Republic of Yugoslavia and to the creation of five independent and sovereign states. Apart from the humanitarian disaster and the devastated economies of the countries created on the territory of the former Yugoslavia, it brought some important issues of international law to the forefront, and provided the impetus for some new and rapid developments. The book is an epilogue to the first, very successful, collection Yugoslavia through Documents: from its creation to its dissolution, published by Martinus Nijhoff Publishers in 1994. However, because of the complexity of the issues in the political, military, humanitarian and legal fields, its structure is different. The book is divided into an Introduction and nine Parts, each of them dealing with specific issues and containing, where appropriate, the Editor's note, comment or additional information. These two volumes constitute an absolutely essential collection for all research libraries.

Available in PDF, EPUB and Kindle. Book excerpt: The international law on the use of force is one of the oldest branches of international law. It is an area twinned with the emergence of international law as a concept in itself, and which sees law and politics collide. The number of armed conflicts is equal only to the number of methodological approaches used to describe them. Many violent encounters are well known. The Kosovo Crisis in 1999 and the US-led invasion of Iraq in 2003 spring easily to the minds of most scholars and academics, and gain extensive coverage in this text. Other conflicts, including the Belgian operation in Stanleyville, and the Ethiopian Intervention in Somalia, are often overlooked to our peril. Ruys and Corten's expert-written text compares over sixty different instances of the use of cross border force since the adoption of the UN Charter in 1945, from all out warfare to hostile encounters between individual units, targeted killings, and hostage rescue operations, to ask a complex question. How much authority does the power of precedent really have in the law of the use of force?

Available in PDF, EPUB and Kindle. Book excerpt: Threats of force are an inherent part of communication between some States. One prominent example is the 2017–2018 crisis in relations between the United States and North Korea, marked by multiple threats issued by both sides. Yet, despite the fact that States seem to use threats of force with unlimited freedom, they are prohibited by international law. This book presents threats of force from the perspective of the practice of States. Thus, the book is based on an examination of multiple cases when States reported threats of force. It describes what threats of force are, examines the status of the prohibition of threats of force as a legal norm, presents examples and describes the mechanisms that are available for States in case threats occur, as well as their legal consequences. The book will be an invaluable resource for academics and researchers in the areas of international security law, public international law, law of armed conflict and international relations.

Available in PDF, EPUB and Kindle. Book excerpt: Armed non-state actors (ANSAs) often have economic aims that international law needs to respond to. This book looks at the aim of Islamic State to create an effective government, with an economically independent regime, which focused on key oilfields in Syria and Iraq. Having addressed Islamic State's quest for energy resources in Iraq and Syria, the book explores the lawfulness of the war with Islamic State from a variety of legal aspects. It has been attempted to make inroads into the most controversial aspects of contradictions in the application of jus ad bellum and jus in bello, particularly when discussing the use of extraterritorial armed force against ANSAs, and the obligation to protect civilian objects, including the natural environment. The question is whether the targeting of energy resources should be regarded as a violation of the laws of armed conflict, even though the war with Islamic State being classified as a non-international armed conflict. Ambitious in scope, the study argues that legal theory and state practice are still problematic as to how and under what conditions states can justify resorting to military force in foreign territory, and to what extent they can target natural resources as being part of state property. Furthermore, it goes on to examine the differences between international and non-international armed conflicts, to establish whether there is any difference in the targeting of energy resources as part of the war-sustaining capabilities of either party. Through an examination of the Islamic State case, the book offers a comprehensive study to close the gaps in jus in bello by contextualising the questions of civilian protection, victimisation and state responsibility by evaluating the US's war-sustaining theory as a justification for the destruction of a territorial state's natural resources that are occupied by ANSAs.

Book excerpt: The South China Sea is arguably one of the world’s most dangerous regions, with conflicting diplomatic, legal, and security claims by major and mid-level powers. To assess these disputes, CSIS brought together an international group of experts—from Australia, Canada, China, Indonesia, Japan, Malaysia, the Philippines, the United Kingdom, the United States, and Vietnam. This volume gathers these experts’ analyses to provide a diverse and wide-ranging set of perspectives on the region and to explore possibilities for future cooperation.
