Book excerpt: Frappe au sceau de l'intérêt général, le droit immobilier contemporain bouscule, modifie, transforme les concepts de notre société pour les asservir aux exigences de l'action publique. Ainsi en matière de lotissement a-t-il perturbe l'ordre juridique apparemment bien établi selon lequel les servitudes de lotissement avaient un régime juridique autonome. En effet, jusqu'a la reforme du régime des lotissements opérée en 1977, les prescriptions régissant les lotissement se caractérisaient par leur dualité de nature, réglementaire envers l’administration, contractuelle entre le lotisseur et les colotis et entre ces derniers. Elles étaient donc en parfaite adéquation avec le concept classique du lotissement, opération satisfaisant a la fois l'utilité publique et l'intérêt prive et collectif des colotis. Désormais, cette solution n'existe plus. Différents textes, depuis 1958 ont, dans un souci de simplification mais aussi pour faire prévaloir dans le cadre juridique des lotissements les règles ordinaires de la planification, scinde en deux le régime juridique des servitudes de lotissement. Ces prescriptions doivent être assimilées soit a des simples règles d'urbanisme ou a des servitudes d'utilite publique soit a des simples servitudes de droit civil. Ceci étant la jurisprudence n'a pas, aujourd'hui encore, réussi a mettre fin aux incertitudes qui règnent sur les critères a utiliser pour déterminer la nature des prescriptions régissant les lotissements autorises avant le 1er janvier 1978.

Each chapter reveals patterns of power circulating through the ‘colonial present’, Cold War legacies, and the global ‘war on terror". Seeking to render legible the more quotidian struggles and livelihoods of people who find themselves defined as refugees, this book will be of great interest to international humanitarian agencies, as well as migration and refugee researchers, including scholars in refugee studies and human displacement, human security, globalization, immigration, and human rights.
