Book excerpt: This set of essays explores how constitutions change and are changed in a number of countries, and how the 'constitution' of the EU changes and is changed. For a range of reasons, including internal and external pressures, the constitutional arrangements in many countries are changing. Constitutional change may be formal, involving amendments to the texts of Constitutions or the passage of legislation of a clearly constitutional kind, or informal and organic, as where court decisions affect the operation of the system of government, or where new administrative and other arrangements (eg agencification) affect or articulate or alter the operation of the constitution of the country, without the need to resort to formal change. The countries in this study include, from the EU, a common law country, a Nordic one, a former communist state, several civil law systems, parliamentary systems and a hybrid one (France). Chapters on non EU countries include two on developing countries (India and South Africa), two on common law countries without entrenched written constitutions (Israel and New Zealand), a presidential system (the USA) and three federal ones (Switzerland, the USA and Canada). In the last two chapters the editors conduct a detailed comparative analysis of the jurisdiction-based chapters and explore the question whether any overarching theory or theories about constitutional change in liberal democracies emerge from the study.

Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. The Schengen area, established in 1985 and today encompassing twenty-nine European countries, allows people, goods, and capital to cross borders without restraint. Schengen transformed European life, advancing both a democratic project of transnational citizenship and a neoliberal project of international free trade. But the right of free movement always excluded non-Europeans, especially migrants of color from former colonies of the Schengen states. In Europe without Borders, Isaac Stanley-Becker explores the contested creation of free movement in Schengen, from treatymaking at European summits and disputes in international courts to the street protests of undocumented immigrants who claimed free movement as a human right. Schengen laid the groundwork for the making of a single market and the founding of the European Union. Yet its emergence is one of the great untold stories of modern European history, one hidden in archives long embargoed. Stanley-Becker is among the first to have access to records of the treatymaking—such as letters between France’s François Mitterrand and West Germany’s Helmut Kohl—and Europe without Borders offers a pathbreaking account of Schengen’s creation. Stanley-Becker argues that Schengen gave a humanist cast to a market paradigm; but even in pairing the border crossing of human beings with the principles of free-market exchange, this vision of free movement was hedged by alarm about foreign migrants. Meanwhile, these migrants—the sans-papiers—saw in the promise of a borderless Europe only a neocolonial enterprise.

Book excerpt: This book provides an account and explanation of a fundamental dilemma facing secular states: the 'legitimacy gap' left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The 'secular' in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a 'substantive' legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of 'procedural' legitimacy (people, rights, and culture) in different ways: the 'neutral model' (constitutions based on the 'displacement of culture'); the 'multicultural model' (constitutions based on diversity and pluralism); and the 'asymmetric model' (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards 'nationalization' linked to a particular national identity (as in France and, to some extent, in India)-or towards 'de-secularization', whereby secularism is displaced by particular cultural norms, as in Malaysia.

Book excerpt: This book offers a comparative perspective on the semi-presidential regimes of Portugal and Timor-Leste, suggesting that they both reserve a “moderating power” for presidents in line with what was theorized by Benjamin Constant. Historical legacies, political culture and short-term political considerations combined create an institutional design that has endured and produced incentives to power-sharing and inclusiveness. A critical element of this model finds roots in the electoral system facilitating the emergence of “independent” presidents with political platforms that tend to supersede those of political parties. Elected presidents dispose of an array of competences that do not overlap with those of prime ministers, but represent a category of its own. The vast array of presidential competences contributes to reinforcing a system of checks and balances, and to foster horizontal accountability. The book argues that this specific form of government with “moderating powers” and presidents who are largely “independent” from the party system contributed to the successful democratic transitions of Portugal and Timor-Leste.
