Néanmoins, les Codes de procédure pénale et de droit pénal intègrent pleinement ces entités abstraites. Il est expressément prévu depuis la promulgation du Code pénal de 1994, la responsabilité pénale des personnes morales de droit public. Cependant tant sur le fond que sur la forme l’arsenal législatif existant ne paraît pas adapté à la spécificité des personnes morales de droit public. Par ailleurs, les personnes morales de droit public ne sont pas seulement des auteurs, intervenant lors de l’action publique mais aussi des acteurs lors de l’action civile. D’une part, elles peuvent être défendeurs à l’action civile. En effet, l’Administration peut être appelée en garantie pour les infractions commises par les fonctionnaires qui résultent d’une faute de service. Cependant les cas d’intervention sont très rares puisque le principe reste l’incompétence du juge pénal pour juger l’Administration sur les intérêts civils en raison du principe de séparation des autorités administrative et judiciaire. D’autre part, la personne morale de droit public peut endosser le rôle de partie civile. Or, cette partie civile agit pour demander réparation ou pour se venger. Une personne morale de droit public ne paraît pas légitime à demander vengeance en tant qu’entité abstraite ni à demander réparation d’une atteinte à ses sentiments. Dans chacun des rôles qu’elle peut tenir la personne morale de droit public semble donc trouver sa place avec difficultés.

Par ailleurs, si les personnes morales de droit public ne peuvent être débitrices dans une procédure collective, certaines situations de fait sont analysées qui conduisent à proposer une procédure de redressement financier à leur égard. Enfin, l'interventionnisme économique de l'Etat et des collectivités locales par l'intermédiaire de sociétés de droit privé génère des difficultés d'application du droit des procédures collectives issues de l'imbrication du droit privé et du droit public et même une inapplicabilité de fait.

Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups

Book excerpt: The establishment of an area of freedom, security and justice is one of the key objectives of the Treaty of Amsterdam. Measures to harmonize criminal law as well as measures in the field of police and judicial cooperation in criminal matters are an integral part of the strategy by which to attain this objective. On the basis of the conclusions of the European Council meeting at Tampere (1999), it is obvious that measures are needed so as to guarantee the real mutual recognition of judicial decisions in criminal matters, including the pre-trial decisions, and to guarantee the free circulation of criminal evidence. The original Corpus Juris study (1997) had elaborated a number of guiding principles in relation to the protection of the financial interests of the European Union within the framework of the European Judicial Space, including the European Public Prosecutor. This follow-up to the Corpus Juris study aims to analyse the feasibility of the Corpus Juris in relation to the legislation of the Member States and also to analyse the horizontal and vertical cooperation in the Member States. The publication of the follow-up study consists of four volumes. Volume I includes a final synthesis, with a new version of the Corpus Juris (Corpus Juris 2000), and syntheses on the feasibility of the Corpus Juris (draft of 1997) in relation to the legislation of the Member States. Volumes II and III include the 15 national reports concerning the 35 articles of the Corpus Juris (1997 draft). Volume IV relates only to questions concerning horizontal and vertical co-operation. The study was carried out in 1998-1999 upon the request of the European Parliament and the Anti-Fraud Office, OLAF, by researchers from the Association of European Lawyers for the Protection of the Financial Interests of the European Union.

To gain a clear overview of this grey area requires more than knowing about the various constitutional rules. What is also needed is a study of little-known administrative practices and the attitudes of the national courts, where case-law is often as complex as it is diverse. When all these elements are taken into account, the general picture that emerges is a much more subtle one, transcending the classical positions based on the theories of monism and dualism. To grasp this reality and go beyond preconceived ideas, it seemed indispensable to make a thorough analysis of national practices. To this end, the International Law Centre of the University of Paris XIII (Cedin Paris XIII) took the initiative, in 1990, of setting up a network of European international lawyers to work on the theme International norms and legal barriers'. This book presents the outcome of the network's programme. The research was organized on the basis of a single questionnaire which provided the outline of a common workplan, to which each of the contributors has adhered. Detailed comparisons of national practices can now be made, relating in particular to international treaties, acts of international organisations and of the European Communities, and to unwritten international law. This is the first time that such a comprehensive and detailed survey has been made of all thirteen countries. Reading the national reports one after the other provides complete information on domestic practices; reading them crosswise gives a direct comparison between the different countries on specificissues.
