Si cette rencontre entre art et marque a gagné la réalité commerciale et artistique, il va s'agir d'étudier comment le droit appréhende ces nouveaux objets que sont les emprunts d'œuvres et de signes distinctifs, respectivement par les marques et les artistes. En effet, le droit d'auteur et le droit des marques sont deux droits de propriété intellectuelle répondant à deux logiques différentes qui vont témoigner de ces emprunts. Autrement dit, le droit va rendre possibles les échanges créatifs entre marques et artistes, en leur donnant l'opportunité d'exploiter d'une part des œuvres d'art et d'autre part des signes distinctifs ; c'est ce mouvement en miroir qui va faire l'objet de notre étude.
