Les autorités locales se mobilisent-elles de manière stratégique, avec la volonté de mettre en oeuvre de nouvelles politiques, ou ont-elles seulement fait évoluer leur discours pour être dans l'air du temps ou pour capter de nouvelles opportunités de financement ? L'observation et l'analyse rapide d'un certain nombre de politiques locales de développement durable inscrites dans un tel contexte, pose toutefois la question de leur pertinence au regard des enjeux d'un développement durable et de leur capacité réelle à faire évoluer en profondeur l'action publique locale, en d'autres termes de leurs impacts effectifs. On formulera l'hypothèse que les principes du développement durable, à travers des pratiques judicieuses, offrent aux pouvoirs publics locaux une opportunité pour redonner à l'environnement ses multiples dimensions spatiales et sociales. Cette hypothèse sera examinée à travers la gestion de deux éléments les plus techniques du développement durable, l'air et l'eau.

L'expérience étudiée pour les besoins de la démonstration est la gestion intercommunale de l'eau. Dans le processus exploré, l'eau est considérée en tant que ressource focale favorisant la coordination entre les acteurs impliqués dans sa production, sa distribution et sa consommation. En premier lieu, cette étude, au travers d'une approche juridique et économique met en évidence la complexité de la ressource " eau potable " en tant que bien économique hybride (public / privé). Cette phase étant nécessaire avant l'exposé de son système d'exploitation sur le terrain d'étude : un ensemble de trois groupements intercommunaux imbriqués sur le territoire du Calaisis. Au plan de la théorie, une première grille d'analyse, celle de l'institutionnalisme américain, et plus particulièrement le courant néo institutionnaliste, est mobilisée. Dans ce même mouvement, la notion de territoire est explorée ainsi que ses relations avec le monde des institutions. Ce décryptage cherche également à déterminer si la théorie des sites symboliques d'appartenance peut constituer un paradigme de synthèse entre les théories du développement local centrées sur la notion de territoire et l'approche néo institutionnelle. L'auteur s'interroge sur le caractère structurant de l'eau potable en tant que ressource focale. Peut-on considérer l'organisation créée autour d'elle comme un " moteur de cohésion territoriale " ? Permet-elle d'incarner concrètement une possibilité de développement durable local, notamment selon les critères de l'agenda 21 local ? A cet effet, l'analyse patrimoniale est mobilisée. En définitive, cette recherche vise à étudier les conditions de l'organisation des territoires autour d'une ressource naturelle endogène.

Book excerpt: This paper discusses large-scale technologies, which are proposed as emergency solutions for avoiding catastrophic climate change. Their use is highly controversial, notably because of risks of large-scale environmental damage and the danger of distracting from other climate policies. Some of these technologies are known as geoengineering or climate engineering. This paper examines stratospheric aerosol injection, ocean fertilisation, and artificial islands as case studies. As the analysis of the rules of international law relevant to these three technologies shows, international law takes on different and partly conflicting roles towards such technologies. Nonetheless, a strong precautionary legal core opposing risky technological endeavours can be identified. However, there is a danger of this precautionary stance of international law being diluted by research and new regulation that make emergency technologies appear as viable policy options. International law does not currently safeguard against the promise of such technologies distracting from mitigation and adaptation.
