Available in PDF, EPUB and Kindle. Book excerpt: Legitimate Differences challenges the usual portrayal of current debates over thorny social issues including abortion, pornography, affirmative action, and surrogate mothering as moral debates. How can it be said that our debates oppose principles of life to those of liberty, principles of liberty to those of equality, principles of equality to those of fairness, and principles of fairness to those of integrity, when we as Americans share all these principles? Debates over such issues are not, Georgia Warnke argues, moral debates over which principles we should adopt. Rather, they are interpretive debates over the meanings of principles we already possess. Warnke traces the structure of these debates with reference to the work of Jane Austen, Hans-Georg Gadamer, Jürgen Habermas, and Bernard Williams. In separate chapters on surrogate mothering, affirmative action, abortion, and pornography she articulates new understandings of the meanings of some of our principles and shows the equal legitimacy of some different interpretations of the meanings of others. Finally, she suggests that the orientation of American public policy ought to be directed less at finding single canonical interpretations of our principles than at accommodating different legitimate understandings of them. The perspective offered by Legitimate Differences should have a significantly beneficial effect on public discussions.

Book Synopsis Progress in Self Psychology, V. 16 by : Arnold I. Goldberg
Download or read book Progress in Self Psychology, V. 16 written by Arnold I. Goldberg and published by Routledge. This book was released on 2013-06-17 with total page 392 pages. Available in PDF, EPUB and Kindle. Book excerpt: Volume 16 of Progress in Self Psychology, How Responsive Should We Be, illuminates the continuing tension between Kohut's emphasis on the patient's subjective experience and the post-Kohutian intersubjectivists' concern with the therapist's own subjectivity by focusing on issues of therapeutic posture and degree of therapist activity. Teicholz provides an integrative context for examining this tension by discussing affect as the common denominator underlying the analyst's empathy, subjectivity, and authenticity. Responses to the tension encompass the stance of intersubjective contextualism, advocacy of "active responsiveness," and emphasis on the thorough-going bidirectionality of the analytic endeavor. Balancing these perspectives are a reprise on Kohut's concept of prolonged empathic immersion and a recasting of the issue of closeness and distance in the analytic relationship in terms of analysis of "the tie to the negative selfobject." Additional clinical contributions examine severe bulimia and suicidal rage as attempts at self-state regulation and address the self-reparative functions that inhere in the act of dreaming. Like previous volumes in the series, volume 16 demonstrates the applicability of self psychology to nonanalytic treatment modalities and clinical populations. Here, self psychology is brought to bear on psychotherapy with placed children, on work with adults with nonverbal learning disabilities, and on brief therapy. Rector's examination of twinship and religious experience, Hagman's elucidation of the creative process, and Siegel and Topel's experiment with supervision via the internet exemplify the ever-expanding explanatory range of self-psychological insights.

Book Synopsis Stability and Legitimate Expectations in International Energy Investments by : Rahmi Kopar
Download or read book Stability and Legitimate Expectations in International Energy Investments written by Rahmi Kopar and published by Bloomsbury Publishing. This book was released on 2021-08-12 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book assesses stability guarantees through the lens of the legitimate expectations principle to offer a new perspective on the stability concept in international energy investments. The analysis of the interaction between the concepts of stability and legitimate expectations reveals that there are now more opportunities for energy investors to argue their cases before arbitral tribunals. The book offers detailed analyses of the latest energy investment arbitral awards from Spain, Italy and the Czech Republic, and reflects on the state of the art of the legitimate expectations debate and its relationship with the stability concept. The author argues that, in order to achieve stability, the legitimate expectations principle should be employed as the main investment protection tool when a dispute arises on account of unilateral host state alterations. This timely work will be useful to both scholars and practitioners who are interested in international energy law, investment treaty arbitration, and international investment law.
