Available in PDF, EPUB and Kindle. Book excerpt: This study concentrates on three major issues creating a basis for the making of the "Czech-English Law Dictionary with Explanations", namely language, including terminology, in both the Czech and Anglo-American systems of law; the process of legal translation; and the lexicographic method of producing a bilingual law dictionary. Terminology has been considered the most significant feature of language for legal purposes. It encompasses a wide range of special-purpose vocabulary and higher syntactic units, including legal jargon. Conceptual analysis is to be pursued whenever an identical term in the target language does not exist or its full equivalent is in doubt. Legal translation should be based primarily on comparative legal, linguistic and genre analysis in order to make the transfer of legal information as precise, accurate and comprehensible as possible. The primary objective of legal translation is for the target recipient to be provided as explicit, extensive and precise legal information in the target language as is contained in the source text, complemented (by the translator) with facts rendering the original information fully comprehensible in the different legal environment and culture. A dictionary which will help its users to produce legal texts in the target language should be founded upon a profound comparative legal and linguistic analysis that will (a) determine equivalents at the levels of vocabulary, syntax and genre, (b) select the appropriate lexicographic material to be included in the dictionary, and (c) create entries in a user-friendly manner.

Book excerpt: This long needed reference on the innumerable and increasing ways that the law intersects with translation and interpreting features essays by scholars and professions from the United States, Australia, Hong Kong, Iceland, Israel, Japan, and Sweden. The essays range from sophisticated treatments of historical and hence philosophical variations in concept and practice to detailed practical advice on self-education. Essays show a particular concern for the challenges of courtroom discourse when the parties not only use different languages but operate from different cultural and legal traditions.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a survey of how law, language and translation overlap with concepts, crimes and conflicts. It is a transdisciplinary survey exploring the dynamics of colonialism and the globalization of crime. Concepts and conflicts are used here to mean ‘conflicting interpretations’ engendering real conflicts. Beginning with theoretical issues and hermeneutics in chapter 2, the study moves on to definitions and applications in chapter 3, introducing cattle stealing as a comparative theme and global case study in chapter 4. Cattle stealing is also known in English as ‘rustling, duffing, raiding, stock theft, lifting and predatorial larceny.’ Crime and punishment are differently perceived depending on cultures and legal systems: ‘Captain Starlight’ was a legendary ‘duffer’; in India ‘lifting’ a sacred cow is a sacrilegious act. Following the globalization of crime, chapter 5 deals with human rights, ethnic cleansing and genocide. International treaties in translation set the scene for two world wars. Introducing ‘unequal treaties’ (e.g. Hong Kong), chapter 6 highlights disasters caused by treaties in translation. Cases feature American Indians (the ‘trail of broken treaties’), Maoris (Treaty of Waitangi) and East Africa (Treaty of Wuchale).

This book was released on 2017-04-12 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on legal concepts from the dual perspective of law and terminology. While legal concepts frame legal knowledge and take center stage in law, the discipline of terminology has traditionally been about concept description. Exploring topics common to both disciplines such as meaning, conceptualization and specialized knowledge transfer, the book gives a state-of-the-art account of legal interpretation, legal translation and legal lexicography with special emphasis on EU law. The special give-and-take of law and terminology is illuminated by real-life legal cases which demystify the ways courts do things with concepts. This original approach to the semantics of legal concepts is then incorporated into the making of a legal dictionary, thus filling a gap in the theory and practice of legal lexicography. With its rich repertoire of examples of legal terms in different languages, the book provides a blend of theory and practice, making it a valuable resource not only for scholars of law, language and lexicography but also for legal translators and students.

Available in PDF, EPUB and Kindle. Book excerpt: One of the first attempts to present a comprehensive study of legal translation, this book is an interdisciplinary study in law and translation theory. It is not bound to any specific languages or legal systems, although emphasis is placed on translation between common law and civil law jurisdictions. The main focus is on the translation of texts which are authoritative sources of the law; examples are cited primarily from statutes, codes and constitutions (Canada, Switzerland and Belgium), as well as instruments of the European Union and international treaties and conventions. Dealing with theoretical as well as practical aspects of the subject matter, the author analyses legal translation as an act of communication in the mechanism of the law, thus making it necessary to redefine the goal of legal translation. This book is intended for both lawyers and linguists, translation theorists, legal translators and drafters, legal lexicographers, as well as teachers and students of translation.

Part I of the collection focuses on the exploration of legal translatability from a theoretical angle. Covering fundamental issues such as equivalence in legal translation, approaches to legal translation and the interaction between judicial interpretation and legal translation, the authors offer contributions from philosophical, rhetorical, terminological and lexicographical perspectives. Part II focuses on the analysis of legal translation from a practical perspective among different jurisdictions such as China, the EU and Japan, offering multiple and pluralistic viewpoints. This book presents a collection of studies in legal translation which not only provide the latest international research findings among academics and practitioners, but also furnish us with a new approach to, and new insights into, the phenomena and nature of legal translation and legal transfer. The collection provides an invaluable reference for researchers, practitioners, academics and students specialising in law and legal translation, philosophy, sociology, linguistics and semiotics.

Drawing on a contrastive-comparative approach, it analyses parallel authentic legal documents in both Arabic and English to examine the features of legal discourse in both languages and uncover the different translation techniques used. In so doing, it addresses the following questions: What are the features of English and Arabic legal texts? What are the similarities and differences of English and Arabic legal texts? What are the difficult areas of legal translation between English and Arabic legal texts? What are the techniques for translating these difficult areas on the lexical and syntactic levels? Features include: A thorough description of the features of legal translation in both English and Arabic, drawing on empirical new research, corpus data analysis and strategic two-way comparisons between source texts and target texts Coverage of a broad range of topics including an outline of the chosen framework for data analysis, a historical survey of legal discourse developments in both Arabic and English and detailed analyses of legal literature at both the lexical and syntactic levels Attention to common areas of difficulty such as Shariah Law terms, archaic terms and model auxiliaries Many examples and excerpts from a wide selection of authentic legal documents, reinforced by practical discussion points, exercises and practice drills to encourage active engagement with the material and opportunities for hands-on learning. Wide-ranging, scholarly and thought-provoking, this will be a valuable resource for advanced undergraduates and postgraduates on Arabic, Translation Studies and Comparative Linguistics courses. It will also be essential reading for translation professionals and researchers working in the field.

The intention is to point out the major differences between the legal realities, which significantly affect the process of translation. Secondly, the following characteristic features of lingua legis, concerning the level of words and syntagmas, are touched upon: vocabulary used in lingua legis including technical and semi-technical terms, conservatism of legal texts (Latin and Latinisms; synonymous strings, archaic adverbs etc.), borrowings, terms with non-precise meanings (the problem of indeterminacy), neologisms, euphemisms, vulgarisms, performative verbs, metaphors and religious elements, prepositional phrases, time expressions, compound nouns and the problems connected with nominalization, false cognates which cause major misunderstandings, and finally methods of providing translation equivalents. The problem of ambivalence is analysed as well. The problems connected with the Polish-English and English-Polish translation of the texts belonging to the following legal genres are examined: university diplomas and certificates, statutes, judgments, law reports, powers of attorney, petitions, contracts and deeds, testaments, birth, death and marriage certificates, and popular fiction.

Available in PDF, EPUB and Kindle. Book excerpt: Thesis (M.A.) from the year 2008 in the subject English Language and Literature Studies - Other, grade: 2, University of Münster (Arbeitsbereich Sprachwissenschaft), course: Dialogue Studies, language: English, abstract: In this paper, the major aspects of and essential developments in translation theory, including the ever-recurring question of what constitutes a good translation, will be explored and the particularity of legal translation will be discussed. In the translation of national law terms, many facets have to be kept in mind. For example, the mastering of the different languages poses problems as does the relation of legal texts to different and specific legal systems and cultures. The focus will then switch to legal language in particular. The opposition between word meaning of everyday language and the word meaning of languages for specific purposes will be clarified. Then, particular difficulties in legal language and translation with consideration of the different legal systems where these translations are used will be illustrated with respect to the nature of legal discourse, its dependence on the legal system and the presentation of possible ambiguities and their interpretation. The problem of a common legislation in the European Union is one of finding a legal terminology that is not influenced by its cultural environment – an entirely impossible enterprise.

Book excerpt: This new dictionary provides a ready reference to essential terms and phrases used in all areas of law and business, including accounting, banking, civil law, civil procedure, contracts, corporate law, criminal law, criminal procedure, economics, intellectual property, labor law, real property, secured transactions, securities law, and torts. Written by an American attorney who is also an accredited translator, it provides complete coverage of terminology used in all Spanish-speaking countries, not just those countries where the other bilingual dictionaries on the market were written (i.e., Spain and Argentina). Accordingly, it is the only source for translations of terms that are unique to countries such as Colombia, Peru and Venezuela. The dictionary was thoroughly researched using original documents and monolingual dictionaries from the Spanish-speaking various countries and is thus authoritative and up-to-date. No lawyer or translator who works with Spanish legal and business documents can afford to be without it.

Book excerpt: This work presents the basic legal terminology used in the English language with equivalent terms from German, principally, and French secondarily: that is because the French term is often some cognate to English. The dictionary includes definitions in English for most, not all terms because sometimes a simple synonym suffices or the concept is obvious on sight to someone with at least the training of a paralegal. Latin and Italian terms are also occasionally represented as well. The Translator's Law Dictionary is useful to legal translators, comparative lawyers, and internationally active law firms as well as scholars of comparative and international law. While no multilingual law dictionary authored by one person in one lifetime could ever hope to be complete, this dictionary tries to present all the basics in current legal usage in the English language and equivalent concepts and terms from German and French. This dictionary has focused on the procedural and substantive facts of law, the indisipensable structural framework to any deeper discussion of the law. As well as the basics of law, this law has tried to present the essentials of commercial law: contracts, torts, corporations, and taxation. Obscure and ancient legal concepts and esoteric theoretical concepts are not discussed here, for such are rarely, if ever, used in practice. Rather, this works presents a well rounded, and reasonably complete exposition of the basic legal terminology of the world's greatest legal systems as part of the construction of the globalization of the rule of law. Thus, while practical and focused, the work also has some hopeful utility for visionaries, enabling jurists to anchor their concepts into new legal systems they will discover in the pages of this work.

Book excerpt: The translation of law has played an integral part in the interaction among nations in history and is playing a greater role in our increasingly interconnected world today. The book investigates legal translation in its many facets as an intellectual pursuit and a profession. It examines legal translation from an interdisciplinary perspective, covering theoretical and practical grounds and linguistic as well as legal issues. It analyses legal translation competence and various types of legal texts including contracts, statutes and multilateral legal instruments, presents a comparative analysis of the Common Law and the Civil Law and examines the case law from Canada, Hong Kong and the European Court of Justice. It attempts to demonstrate that translating law is a complex act that can enrich law, culture and human experience as a whole.

A scarce, important original American dictionary by a student of James Kent. Burrill [1807-1869] was admitted to the New York Bar in 1828. Burrill was highly regarded for his legal scholarship. Dictionary of American Biography describes this as "a work of very high standard, which at once took its place as perhaps the best book of its kind so far produced...All his books were distinguished for their graceful style and a scholarly precision and finish which earned the unstinted commendation of the judiciary. In addition their accuracy of statement and definition was fully recognized at the time by the profession at large" (II:326).
