Book excerpt: Excerpt from Leading Cases on International Law Lastly I would express my obligation to the West Publishing Co., St. Paul, for an advance copy of the opinion in The Appam, and to Mr. E. H. Redstone, the indefatigable librarian of the Social Law Library, Boston, whose assistance has been of the greatest value. To the users of this book I commend the cau tion of Littleton: And know, my son, that I would not have thee believe that all that I have said in these books is law, for I will not presume to take this upon me. But of those things which are not law, inquire and learn of my wise masters learned in the law. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Students Leading Cases and Statutes on International Law I have endeavoured to classify the cases in groups of three or more which illustrate different aspects of the same subject, and in the notes I have given references to decisions which bear upon the same question or suggest a different view. Save in one or two cases, where it did not seem necessary, I have prefixed to the judgment a headnote and a summary statement of the facts. And at the head of each division of the subject I have given the references to the sections or pages of the principal English text-books on international law which are used by students. Book excerpt: Excerpt from Cases on International Law: Selected From Decisions of English and American Courts; Edited With Syllabus and Annotations It is the judgment that is authoritative, although the obiter dictum of a distinguished judge is entitled to respect. The opinion of a text-book writer is valuable; but, like the dictum, it is not in itself law. It is at best a statement of the underlying principle of the law or a digest or summary of cases on the subject with which the text-book deals. The opinions of diplomats likewise carry great weight; but the diplomatist does not and cannot consider the ques tion at issue with the impartiality of a judge, for he is influenced by the interests of 'his country. Book excerpt: Excerpt from Students Leading Cases and Statutes on International Law This book is primarily designed for students who are starting on the study of international law; and it is meant to be used as a companion to the principal English text-books. No attempt has been made to render it sufficient in itself, or to link up the leading cases with such an amount of commentary as would render the use of a text-book unnecessary. In this respect the collection of cases differs from that made by Mr. Pitt-Cobbett, and it differs also in that it gives the ipsissima verba of the judges, in place of a digest or summary of their judgments. Many of the decisions are indeed abridged, but it is hoped that the material parts which deal with points of international law have always been given. It is very desirable that the student should become acquainted as early as possible with the way in which questions of international law are dealt with by the Courts, and that he should study not only the results of the cases but the methods by which the results are reached. There exists already a well-known selection of international law cases in English, based on this principle. It is that originally made by Professor Snow and subsequently edited and enlarged by Professor J. B. Scott of the George Washington University. For two reasons, however, the book is not altogether suitable for English students; it is somewhat large, and the selection is primarily made from American decisions. Although the judgments of international law by the nature of their subject should not differ fundamentally in different national jurisdictions, there is an obvious advantage to the student in studying the subject as it has been expounded by the Courts of his own country. Book excerpt: Excerpt from The Development of International Law After the World War In accordance with its original character, this book offers only a survey of the future problems of international law. In this work I have given merely some directing outlines. I have been obliged to forgo entering upon the individual problems here, since this would have claimed materially more space and also more time. But I also believe that m the present hour it 18 above all necessary to call to mind once more the fundamental tendencies in the development of international law. The problems to be solved for international law in the future are neither simple nor small in number. We may rejoice if, upon the conclusion of peace, we succeed in obtaining an agreement on the basic principles. The future work will, however, take decades. Book excerpt: Excerpt from Cases on Private International Law Most of the cases which occupy an English Court are in every respect of a purely English character; the parties are English men, and the cause of action arises wholly in England, as where A, a London tradesman. Sues X, a citizen Of London, for the price of goods sold and delivered in London. When this is so, every act done, or alleged to be done, by either of the parties clearly de pends for its legal character on the ordinary rules of English law. The book introduces the history and nature of international law and its sources--treaties, custom, general principles, jus cogens, and equity. It explains how international law is applied in U.S. courts and in international arbitration and adjudication. The book addresses many of the key settings in which international law plays a critical role: international human rights, the recognition and succession of states and governments, international and non-governmental organizations, war and peace, the law of the sea, and inter-state judicial relations. The book's materials, largely domestic and international judicial decisions, are both sophisticated and teachable, the perfect introductory casebook for any U.S. law school.

Book excerpt: Excerpt from International Law and International Relations, an Attempt to Ascertain the Best Method of Discussing the Topics of International Law The following essay is a dissertation which I wrote last year as a candidate for a Fellowship at King's College, Cambridge. Except in so far as it deals with the theory of International Law it is necessarily a mere sketch, as my object was only to state a theory and to give an outline of its application. It has interested some of its few readers sufficiently to encourage me to publish it. I have not amplified it at all because I can see no value in any work occupying an intermediate position between an essay intended to excite interest in the subject and to indicate what might be done and an elaborate work on International Law such as I may hope to write some day but for which much time and labour would be required. At the same time I have revised the essay and made some alterations in it. Its nature and purpose are further explained in the introductory letter which was prefixed to it in its earlier form and which I here reprint. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Notes on International Law The modern conception of a state occupying a definite area of territory has gradually arisen out of the settlements made by the Teutonic tribes on the wreck of the Roman Empire. Scattered Teutonic tribes gathered into larger wholes, nations. They were migratory nations, and the idea Of sovereignty was not connected with domain over any particular part of the earth's surface. Alaric was king of the Goths wherever they might be, on the banks of the Tagus, the Tiber, or the Danube. These conquering tribes were at first simply encamped on the wreck of the Roman Empire, but gradually, by what is called the process of feudalization the elec tive chiefs became hereditary lords of given areas Of land. This idea did not become dominant, however, until after the breaking up of the Empire of Cha'rles the Great, out of the fragments of which arose most of the modern states of Europe. The comple tion of the transition from personal to territorial sovereignty is marked by the accession of the Capetian Dynasty in France. Book excerpt: Excerpt from International Law Situations: With Solutions and Notes, 1932 It is now generally admitted that a neutral should not permit its territory to be used as a base by a belligerent, but it is not always clear as to what constitutes such use and illustrations of this fact may be found in practically every modern war. As a state is, in consequence of the allegiance of its subjects, under a degree of responsibility for their acts, these acts therefore must be supervised within and to a degree outside its jurisdiction. Book excerpt: Excerpt from Handbook of International Law T hus, after nearly three hundred years from the founda tions laid by Grotius, the father of International Law, in 1625, there rises a worthy structure and in a single decade the advance made in centuries is surpassed. Where earlier writ ers referred to philosophical or religious sanctions to fortify their expression of hope that justice might prevail among the nations, the writers of the present day refer to the sanction of international conventions embodying the realization of these hopes. Hubner, a century and a half ago, suggested an international prize court; in 1907 a convention for establish ing such a court was drawn up, and is a typical example of the modern realization of the hopes of the early writers.
