Book excerpt: L'APPROCHE TRADITIONNELLE CONSISTE A VOIR DANS LE TRAFIC INTERNATIONAL DE STUPEFIANTS UN PROBLEME DE SOUS DEVELOPPEMENT. CETTE THEORIE UNANIMEMENT ET UNIVERSELLEMENT ADMISE SELON LAQUELLE LE TRAFIC INTERNATIONAL DE STUPEFIANTS TROUVE SON EXPLICATION DANS LA SITUATION ECONOMIQUE ET SOCIALE DES PAYS EN VOIE DE DEVELOPPEMENT, N'A POURTANT JAMAIS ETAIT ETABLIE. OR IL S'AVERAIT D'AUTANT NECESSAIRE D'EN DEMONTRER LA REALITE, QU'A L'HEURE ACTUELLE TOUTE L'APPROCHE DES DROGUES SE TROUVE CONCENTREE SUR LA QUESTION DE L'OFFRE DE STUPEFIANTS. RECHERCHER LA REALITE DE L'INFLUENCE DE L'ECONOMIE DES PAYS EN VOIE DE DEVELOPPEMENT SUR LE TRAFIC INTERNATIONAL DE STUPEFIANTS IMPLIQUAIT NON SEULEMENT UNE ANALYSE DU TRAFIC DANS LE CONTEXTE ECONOMIQUE ET SOCIAL DES PAYS ENGAGES DANS CETTE ACTIVITE, MAIS AUSSI, PLUS EN AMONT, UNE ETUDE DE L'HISTOIRE DES DROGUES ET DU DROIT INTERNATIONAL DE LA DROGUE. OR LES CONCLUSIONS AUXQUELLES ELLE A PERMIS D'ABOUTIR VONT A CONTRE-COURANT DE L'IDEE RECUE. EN EFFET, IL RESSORT DE CES RECHERCHES QU'IL EST MATERIELLEMENT IMPOSSIBLE DE DEMONTRER QUE L'ECONOMIE DES PAYS EN VOIE DE DEVELOPPEMENT EST LA CAUSE OU L'EXPLICATION DU TRAFIC. CETTE IMPOSSIBILITE TIENT A DES CONSIDERATIONS METHODOLOGIQUES INHERENTES AU CONCEPT MEME D'ECONOMIE DES PAYS DU TIERS-MONDE. MAIS EN REVANCHE, ELLES ONT PERMIS DE DEMONTRER QUE L'ECONOMIE DES PAYS DU TIERS-MONDE NE PEUT ETRE TENUE POUR LA CAUSE DU TRAFIC, MAIS TOUT AU PLUS POUR UN FACTEUR FAVORISANT, PUISQU'EN EFFET, IL EST APPARU QUE CE PHENOMENE RESULTE DE MULTIPLES FACTEURS ECONOMIQUES, MAIS AUSSI HISTORIQUES, GEOGRAPHIQUES, JURIDIQUES ET SOCIO-CULTURELS QUI NE SONT PAS SPECIFIQUES AUX PAYS DU TIERSMONDE. CETTE ETUDE AURA DONC EN DEFINITIVE PERMIS DE DEMONTRER QUE CONTRAIREMENT A L'IDEE RECUE, LE TRAFIC INTERNATIONAL DE STUPEFIANTS N'EST PAS UN PROBLEME DE SOUS DEVELOPPEMENT MAIS UN PHENOMENE FONDAMENTALEMENT CRIMINEL.

Book excerpt: "The 12th volume of International Development Policy explores the relationship between international drug policy and development goals, both current and within a historical perspective. Contributions address the drugs and development nexus from a range of critical viewpoints, highlighting gaps and contradictions, as well as exploring strategies and opportunities for enhanced linkages between drug control and development programming. Criminalisation and coercive law enforcement-based responses in international and national level drug control are shown to undermine peace, security and development objectives. Available in PDF, EPUB and Kindle. Book excerpt: In the aftermath of an armed conflict in Africa, the international community both produces and demands from local partners a variety of blueprints for reconstructing state and society. The aim is to re-formalize the state after what is viewed as a period of fragmentation. In reality, African economies and polities are very much informal in character, with informal actors, including so-called Big Men, often using their positions in the formal structure as a means to reach their own goals. Through a variety of in-depth case studies, including the DRC, Sierra Leone and Liberia, this comprehensive volume shows how important informal political and economic networks are in many of the continent’s conflict areas. Moreover, it demonstrates that without a proper understanding of the impact of these networks, attempts to formalize African states, particularly those emerging from wars, will be in vain.

Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups

Available in PDF, EPUB and Kindle. Book excerpt: The first comprehensive analysis of anti-drug crusades in twentieth-century China, this book chronicles the evolution of ChinaOs anti-narcotics movement from its shaky but enthusiastic beginnings in 1906, through its dramatic success in the early years of the communist regime, to its continuance today in the face of resurgent opium and heroin use. Especially valuable is the authorOs detailed description of the CCPOs successful opium eradication campaigns in the early 1950s, which includes previously unavailable archival information and personal interviews. This rich and multifaceted story will be essential reading for Asia scholars and narcotics researchers alike.
