Book excerpt: L'étude du temps et du procès civil nécessite de distinguer le temps de la procédure et celui du litige. Le temps de la procédure est réglementé afin d'encadrer la libel1é des parties dans l'exercice de l' action et dans la conduite de l' instance. Cette réglementation impose des délais légaux et une chronologie aux actes de procédure. Son efficacité est limitée et une régulation du temps de la procédure est nécessaire. Celte régulation est faite par les parties et par le juge qui adapte le cadre temporel aux situations concrètes et dirige parfois l'instance. Le principe dispositif ne s'applique pas à la procédure. Le temps de la procédure est le résultat d'une coopération des acteurs du procès. Afin d'équilibrer les différents intérêts en présence, une négociation est souhaitable car elle pel1net une meilleure perception et perception du temps. Les procédures sont critiquées du fait de leurs lenteurs mais leur durée procède surtout d'une protection des droits de la défense. Le temps du procès résulte aussi du temps du litige. Son étude montre que le temps est évolutif. La matière litigieuse ne peut se figer au début du procès. La procédure doit intégrer les évolutions du litige dues à l'activité des parties, du juge ou à un changement de législation. Cela remet en cause le principe d'immutabilité du litige et conforte la conception de l'appel comme voie d'achèvement du litige. Ce dernier implique aussi une adaptation structurelle et conjoncturelle des règles de procédure. Des procédures dérogatoires imposent un temps adapté à la structure du litige (procédures collectives, contentieux du divorce). D'autres procédures s'adaptent aux conjonctures du litige en créant des voies parallèles visant à renforcer l'efficacité de la justice, au détriment d'un strict respect des droits de la défense. C'est alors une justice à plusieurs vitesses qui s'instaure et qui doit être contenue afin de ne pas dénigrer l' institution même de la justice.
