Il identifie les sources juridiques qui constituent le fondement de son statut constitutionnel. Il démontre que l'honneur de la Couronne est un principe constitutionnel non écrit qui peut avoir un effet supralégislatif indépendamment de l'application de toute autre disposition expresse de la Constitution canadienne. Cet effet peut opérer en cas de violation arbitraire et sans consultation d'intérêts autochtones historiquement protégés par les textes qui sont à la base de la reconnaissance de l'honneur de la Couronne en tant que principe constitutionnel et qui en constituent les aspects fondamentaux.
