Book excerpt: The carriage of goods by sea starts off with a contract of carriage, an essentially simple and straightforward contract between two parties, the shipper and the carrier. Very often, however, a bill of lading is issued and a third party appears on the scene: the holder of the bill of lading. The holder was not involved in the making of the contract of carriage, but does have rights, and possibly obligations, against the carrier at destination. The question then is how the third-party holder of the bill acquires those rights and obligations. Analysing the different theories that have been proposed to explain the position of the third party holder, this book makes a distinction between contractual theories and non-contractual theories to explain the holder's position. Contractual theories build on the initial contract of carriage and apply contract law mechanisms while non-contractual theories construe the position of the third-party holder independently. Following the analysis and appraisal of the different theories, this book makes the case that the position of the third-party holder of the bill of lading is not obvious or self-evident; and submits that a statutory approach to the position of the holder of the bill of lading has advantages and would be preferable.

In his political history of the making and unmaking of the French absolute monarchy, Sahlins considers the shifting policies toward immigrants, foreign citizens, and state membership.Sahlins argues that the absolute citizen, exemplified in Louis XIV's attempt to tax all foreigners in 1697, gave way to new practices in the middle of the eighteenth century. This "citizenship revolution," long before 1789, produced changes in private and in political culture that led to the abolition of the distinction between foreigners and citizens. Sahlins shows how the Enlightenment and the political failure of the monarchy in France laid the foundations for the development of an exclusively political citizen, in opposition to the absolute citizen who had been above all a legal subject. The author completes his original book with a study of naturalization under Napoleon and the Bourbon Restoration. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.
