Assurer leur protection de manière efficace, non seulement contre ses concurrents mais aussi à l’égard de son personnel, est devenu une exigence de bonne gestion. On constate qu’il n’y a pas de règlementation harmonisée organisant la propriété de la production intellectuelle des salariés, ni dans la législation communautaire ni dans la législation nationale. Certes, des présomptions de cession – légales ou jurisprudentielles – existent parfois en faveur de l’employeur mais elles ne s’appliquent qu’à certains droits de propriété intellectuelle. Or, une même production intellectuelle peut donner lieu à des droits différents. La question posée ne concerne d’ailleurs pas seulement les droits intellectuels « traditionnels » que sont les brevets, le droit d’auteur et dessins et modèles, mais aussi des sujets moins bien connus que sont les logiciels et les bases de données et qui font l’objet aujourd’hui de protections spécifiques. La protection du savoir-faire non brevetable est également extrêmement importante pour beaucoup d’entreprises, grandes ou petites. La question de la protection des actifs incorporels de l’employeur et des droits et obligations des travailleurs est donc une question d’une grande importance pratique. L’intérêt de cet ouvrage est de permettre tant aux juristes praticiens du droit du travail qu’aux spécialistes du droit de la propriété intellectuelle de se sensibiliser à des outils juridiques parfois mal connus, et de se demander si le cadre juridique actuel prend en compte de manière équilibrée les intérêts de toutes les parties en cause. De manière très pratique, cet ouvrage fait également le tour des différentes possibilités d’actions offertes à l’entreprise pour se protéger contre un travailleur ou contre un concurrent. L’objectif de ce colloque est de créer des passerelles entre des pratiques qui souvent s’ignorent, alors qu’elles sont complémentaires.
