Varias decisiones-marco y varias directivas, así como la jurisprudencia del Tribunal Europeo de Derechos Humanos y del Tribunal de Justicia de la Unión Europea, jalonan la interpretación y aplicación interna, que debe ser realizada en torno a las garantías del debido proceso. Ratificado el Convenio Europeo de Derechos Humanos, del ámbito del Consejo de Europa, el artículo 24 de la Constitución Española fue interpretado en conexión con el artículo 6 del mencionado Convenio como estándar mínimo, interpretado éste por el Tribunal Europeo de Derechos Humanos. Una ingente jurisprudencia de este último sirvió de inspiración a nuestro Tribunal Constitucional y al Tribunal Supremo, así como al resto de juzgados y tribunales, en la interpretación de las garantías procesales. El mismo Tratado de la Unión ha considerado que los derechos del Convenio Europeo de Derechos Humanos forman parte del Derecho de la Unión como principios generales (artículo 6.3 TUE). De este modo, el derecho a la tutela judicial efectiva reconocido en nuestra Constitución, encuentra su equivalente en el derecho al debido proceso del artículo 6 del Convenio Europeo de Derechos Humanos y, también, en los artículos 47 a 50 de la Carta de los Derechos Fundamentales de la Unión Europea, relativos al derecho a la tutela judicial efectiva y a un juez imparcial, la presunción de inocencia y derechos de la defensa, los principios de legalidad y de proporcionalidad de los delitos y las penas y el derecho a no ser juzgado o condenado penalmente dos veces por la misma infracción. Con ello, se ha formado un verdadero Sistema Europeo de Derechos Fundamentales, formado por la conjunción de tres ordenamientos: el nacional, el de la Unión Europea y el del Convenio Europeo de Derechos Humanos. Esta obra, resultado de la conjunción del esfuerzo de diferentes especialistas en la materia bajo la coordinación de Teresa Freixes, permite al lector adentrarse en este apasionante sistema y en sus engranajes esenciales.

However, neither common legally binding criteria for deciding the best jurisdiction nor specific rules for the transfer of proceedings (which can occur after parallel proceedings have been identified) were established in this instrument, or in any other instrument adopted by the EU to date. This book analyses the current EU legal framework on conflicts of jurisdiction and transfer of criminal proceedings, paying special attention to its numerous shortcomings and loopholes from a fundamental rights and due process of law perspective. The book begins with an assessment of the various principles and grounds used by Member States for claiming criminal jurisdiction. Secondly, de lege lata EU procedure on the settlement of conflicts of criminal jurisdiction, as well as its implementation in Spain and Italy, are thoroughly examined.
